THE NEW ZEALAND GAZETTE
No. 15
15440 and deposited in the Office of the Ministry of Transport at Wellington subject to the following conditions:
-
A stock proof fence shall be erected around the site to such specifications as may be required by the Ministry of Agriculture and Fisheries.
-
A cattle stop shall be placed at the entrance to the tip site.
-
The existing banks and any future banks shall be impermeable and shall be raised above mean high-water so that the tide will not gain access to the tip.
-
The area in front of the existing tip face shall be filled with inorganic matter and any organic material shall be placed at a level at least 1 ft above mean high-water spring tides.
-
Suitable flood gates shall be placed to allow rain water to flow from the tip but to prevent any access of sea water. Such flood gates shall be adequately maintained and inspected to ensure that they are kept in working condition.
-
Some method such as a movable fence shall be placed on the tip site to curtail tipping along the entire face of the reclamation and to effectively reduce the area available for tipping at any one time. This will allow the minimum area to be kept effectively covered with earth.
-
Tipping of material shall take place above water level.
-
Tip material shall be covered at least once a week with clean fill.
-
A screen of trees shall be planted along the road side perimeter of the reclamation.
-
On completion of the tip area the land reclaimed shall be vested in the Whangaroa County Council as a recreation reserve.
-
In the event of the Whangaroa County Council failing to comply with any of the foregoing conditions the authority to reclaim given by this Order in Council may be revoked by notice in writing signed by the Minister of Transport and in such event the Minister may cause the reclamation to be completed in the manner contemplated by the foregoing conditions and may recover the costs of such completion from the said Council as a debt due to the Crown.
P. G. MILLEN, Clerk of the Executive Council.
