Decision of the Indecent Publications Tribunal

In the matter of the Indecent Publications Act 1963, and in the matter of a reference by the Magistrate’s Court, Hamilton, for a decision in respect of the publication Erotic Art of the Masters (The 18th, 19th and 20th centuries) by Bradley Smith, published by Lyle Stuart Inc., Secaucus, New Jersey, U.S.A.

BEFORE THE INDECENT PUBLICATIONS TRIBUNAL

Messrs L. M. Greig (Chairman), D. M. Wylie, I. R. Cross, and Mrs L. Edmond.

Hearing: 16 August 1976.

Appearances: Mr F. X. Quinn for Commissioner of Police. Written submissions from the importer were received and considered.

DECISION OF THE TRIBUNAL

This book is an art book comprising a collection of copies of paintings and drawings, many in colour, of numerous European and Eastern artists including many of the greatest names in painting. As the title indicates each painting is erotic. The Police in their submissions accepted this book has undoubted honesty of purpose and at its price of $35 must have a limited circulation. It is a serious attempt to gather together erotic paintings of the great masters of art and others, and clearly has an artistic worth presented in a straightforward manner without appeal to prurience.

The Tribunal classifies this book as not indecent.

Dated this 13th day of September 1976.

LAURENCE M. GREIG, Chairman.
