The Motor Launch (Cooks Bay) Notice 1976—Thames-Coromandel District Council

PURSUANT to the Motor Launch Regulations 1962*, I, Owen John Conway, of the Ministry of Transport, in exercise of the powers delegated by the Minister of Transport hereby give the following notice.

NOTICE

  1. (a) This notice may be cited as the Motor Launch (Cooks Bay) Notice 1976.

(b) This notice shall come into force on the date of its publication in the Gazette, and shall remain in force until revoked by further notice in the Gazette.

  1. Subject to the conditions, set forth in the Second Schedule hereto, regulations 11 and 12 of the Motor Launch Regulations 1962* shall not apply with respect to the area described in the First Schedule hereto.

FIRST SCHEDULE

  1. All that area of water in Cooks Bay, situated in Block XI, Otama Survey District, bounded on the side by parallel lines 200 metres apart extending 200 metres from the edge of the water, the western boundary being an extension of the common boundary line between Lots 5 and 6, D.P. 899, Block XI, Otama Survey District, the eastern boundary being an extension of the common boundary between Lots 16 and 17, D.P. 899, Block XI, Otama Survey District, as shown on plan marked M.D. 15765, and deposited in the office of the Ministry of Transport at Wellington.

  2. All that area of water in Cooks Bay, situated in Block XI, Otama Survey District, bounded on the side by parallel lines 200 metres apart extending 200 metres from the edge of the water, the western boundary being an extension of the common boundary between Lots 56 and 57, D.P. 8285, Block XI, Otama Survey District, the eastern boundary being an extension of the common boundary between Lots 2 and 3, D.P. 15943, Block XI, Otama Survey District, as shown on plan marked M.D. 15765, and deposited in the office of the Ministry of Transport at Wellington.

SECOND SCHEDULE

THE access lanes shall be marked as follows:

  1. Two 2.5 metre transit posts, with a distance of not less than 3 metres or more than 6 metres between, and painted with 300 millimetre bright orange and black bands, shall be erected on land in line with each side of each access lane, the first post being sited at high-water mark.

  2. On each side of the transit posts, sited on high-water mark, there shall be a notice board, measuring not less than 800 millimetres × 600 millimetres, painted bright orange with black lettering in the following form:

MOTOR LAUNCH REGULATIONS 1962

Access lane through which motor launches and water skiers may pass at speeds greater than 8 kilometres per hour.

MOORING OF VESSELS AND BATHING PROHIBITED

  1. A set of four marker buoys, either barrel, drum or spherical-shaped, painted bright orange with a vertical black stripe, shall be moored 50 metres apart in line with each set of transit posts, the first buoy being moored 50 metres from high-water mark.

PURSUANT to section 330 of the Maori Affairs Act 1953, the Maori Land Board hereby gives notice as follows.

NOTICE

  1. This notice may be cited as Maori Land Development Notice Wanganui 1976, No. 14.

  2. The land described in the Schedule hereto is hereby declared to be subject to Part XXIV of the Maori Affairs Act 1953.

PURSUANT to the Local Authorities Loans Act 1956, the undersigned Assistant Secretary to the Treasury, acting under powers delegated to the Secretary to the Treasury by the Minister of Finance, hereby consents to the borrowing by the local authorities, mentioned in the Schedule hereto, of the whole or any part of the respective amounts specified in that Schedule.
