O R D E R

  1. (a) This order may be cited as the Wanganui River Scenic Board Waters Control Order 1975.
    (b) This order shall come into force on the date of its publication in the Gazette.

  2. In this order—
    “The Act” means the Harbours Act 1950;
    “Board” means the Wanganui River Scenic Board:
    “Minister” means the Minister of Transport and includes any officer, person or authority acting by or under the direction or authority of the Minister.

  3. There is hereby granted to the Board for a period of 21 years from the commencement of this order, the control of water described in the First Schedule to this order, subject to the provisions of section 8A of the Act, and to the conditions specified in the Second Schedule to this order.

FIRST SCHEDULE

ALL those waters of the Wanganui River commencing at a line across the river bearing 134° true from the southern corner of the Raorikia Maori Reserve and extending upstream to a line passing due north across the river through the northernmost tip of Whakapapa Island and more particularly shown on plan marked M.D. '15611 and held in the office of the Ministry of Transport at Wellington.

SECOND SCHEDULE

CONDITIONS

  1. Her Majesty or the Governor-General and all officers in the Government service acting in the execution of their duty shall, at all times, have free ingress, passage, and egress into, over, through, and out of the waters described in the First Schedule to this order without payment.

  2. Subject to the provisions of section 8A of the Act, the Board for and within the area of waters described in the First Schedule hereto:
    (a) May by bylaw, do anything which a harbour board may do by bylaw under section 232 of the Act;
    (b) May appoint officers and define or limit their powers or duties.

  3. Bylaws made by the Board under the authority of this Order in Council shall not come into force until they have been approved by the Minister by notice in the Gazette.

  4. Nothing herein contained shall authorise the Board to do, or cause to be done, anything repugnant to, or inconsistent with any law relating to the Customs, or with any regulation of the Minister of Customs, or with any provision of the Harbours Act 1950 or its amendments, or any regulations made thereunder that are or may hereafter be in force.

  5. No authority conferred by this Order in Council shall be exercised by the Board in respect of waters now or hereafter used for hydro-electric installations, except with the approval of the New Zealand Electricity Department.

  6. The said rights, powers, privileges, control, functions, duties, and authorities may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the Board 6 calendar months’ notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the last known address of the Board in New Zealand.

Government Railways Appeal Board Appointment of Member

of Invercargill, vice D. C. Goodfellow, to hold office from and including the 10th day of September 1975 to and including the 29th day of February 1976.

Commissioner of Supreme Court Appointed

PURSUANT to section 47 of the Judicature Act 1908, the Right Honourable Sir Richard Wild, K.C.M.G., Chief Justice of New Zealand, has this day appointed

Rainer Michael Ellinghaus

of 161 Lygon Street, Carlton, Victoria, Australia, a solicitor of the Supreme Court of Victoria, to be a Commissioner of the Supreme Court of New Zealand in Victoria for the purpose of administering and taking oaths, affidavits, and affirmations as in the said section mentioned.
