Approval of Motor-cycle Helmets in Terms of Traffic
Regulations 1956

PURSUANT to subclause (1) of regulation 49 of the Traffic
Regulations 1956, the Secretary for Transport hereby approves
for the purpose of regulation 29 of the said regulations,
motor-cycle safety helmets of the make and type described
in the Schedule hereto.

SCHEDULE
SAFETY helmets manufactured by Max Cheshire Limited,
Christchurch, bearing the trade name “Max Cheshire Full
Face” and bearing the certification mark of the Standards
Association of New Zealand, NZS 1884 and the licence
number 2038.

Exempting Certain Traffic Enforcement Vehicles from the
Restrictions as to Flashing Red Lights

PURSUANT to regulation 25A of the Traffic Regulations 1956*
the Chief Automotive Engineer of the Ministry of Transport
acting under the delegated authority of the Secretary for
Transport hereby gives the following notice.

NOTICE
THE vehicles specified in the First and Second Schedules
hereto are hereby exempted from the restriction as to the
number of red lights permitted to be fitted to a motor
vehicle in terms of regulation 39 (3) (a) and (b) of the
Traffic Regulations 1956*, to the effect that they may be
equipped with two red flashing or revolving lights.

FIRST SCHEDULE
PATROL cars used by traffic officers for traffic control purposes.

SECOND SCHEDULE
MOTOR cycles fitted by the manufacturer with two forward
facing red flashing lights used by traffic officers for traffic
control purposes.

Environmental Impact Report Notified—Port Chalmers
Container Terminal Development

THE Commission for the Environment gives notice that it
has received an environmental impact report on the Otago
Harbour Board’s proposal to develop a container wharf at

Port Chalmers. Representations in writing on the environ-
mental aspects of the project, as it is explained in the report,
will be received at the office of the Commission, P.O. Box
12-042, Wellington North, until Friday, 3 October 1975.

Copies of the report may be purchased from the General
Manager, Otago Harbour Board, P.O. Box 1, Dunedin, at
a cost of $2.00. Copies can be seen at the public libraries
at Invercargill, Port Chalmers, Auckland, Wellington, Christ-
church, and Dunedin or at the libraries of the seven university
institutions.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and
in the matter of an application by Waverley Publishing
Company Limited for a decision in respect of the following
publication: The Summer Holiday Sex Manual by Miss
Tuppy Owens and published by Robin Ray of London,
England.

Date of hearing: 30 July 1975, at Wellington.

No appearance of applicant but written submissions received.
Mr P. E. Leloir and Mr K. G. Murray appeared on behalf
of the Comptroller of Customs and made submissions.

DECISION OF THE TRIBUNAL

This book constitutes a series of photographs depicting
sexual intercourse, foreplay, and oral-genitilism performed in
the open air. Its title is pretentious as the book does not
constitute a manual in the generally accepted sense of the
word.

In decisions No. 432–435, the Tribunal set out criteria for
classifying books belonging to this genre of literature. The
Summer Holiday Sex Manual clearly falls into category (c).
The photographs are contrived and the captions are designed
to titillate and excite. The material is tastelessly and insens-
itively presented and no allowance is made for “elements
in the relationship apart from the acrobatics”.

The Tribunal classifies this book as indecent.

Sullivan and published by Bernard Sullivan of Great
Britain.

Date of hearing: 30 July 1975, at Wellington.

No appearance of applicant but written submissions received.
DECISION OF THE TRIBUNAL

This book contains a fairly extensive and informative text
on most aspects of human sexuality. It also includes more
than seventy photographs of couples demonstrating various
sexual techniques.

Taken as a whole, the text is unobjectionable. The photo-
graphs however, appear to have been chosen for their
salacious appeal. Their number is excessive and very few
are in accord with the informative nature of the text. Several
are irrelevant. Thus the photographs would appear to have
no other purpose than to boost sales.

The Tribunal regards the text as camouflage designed to
render the photographs acceptable and considers this book
to be lacking in honesty of purpose.

The Tribunal classifies this book as indecent.
