A PROCLAMATION
PURSUANT to the Public Works Act 1928, I, Sir Edward Denis Blundell, the Governor-General of New Zealand, hereby declare the land described in the Schedule hereto to be Crown land subject to the Land Act 1948.
SCHEDULE
MARLBOROUGH LAND DISTRICT
ALL that piece of land containing 2.2 perches (55 square metres), situated in Block XVI, Cloudy Bay Survey District, Borough of Blenheim, being part Section 5, District of Omaka; as shown coloured blue on Plan S.O. 4708, lodged in the office of the Chief Surveyor at Blenheim.
Given under the hand of His Excellency the Governor-General, and issued under the Seal of New Zealand, this 1st day of May 1975.

ALL that piece of land containing 2 acres and 2 roods (1.0117 hectares) situated in Block VII, Heretaunga Survey District, Hawke's Bay R.D., and being part Blocks 2, 3, and 55, Puketapu Crown Grant District, and being part Lot 1, Deeds Plan 325; as shown on plan P.W.D. 130199 (S.O. 2399) deposited in the office of the Minister of Works and Development at Wellington and thereon coloured blue.
Given under the hand of His Excellency the Governor-General, and issued under the Seal of New Zealand, this 7th day of May 1975.

The Rotorua City Waters Control Order 1975

ORDER IN COUNCIL
At the Government Buildings at Wellington this 28th day of April 1975
Present:
THE HON. W. W. FREER PRESIDING IN COUNCIL
PURSUANT to section 8A of the Harbours Act 1950, His Excellency the Governor-General acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
- (a) This order may be cited as the Rotorua City Waters Control Order 1975.
(b) This order shall come into force on the date of its publication in the Gazette.
- In this order—
“The Act” means the Harbours Act 1950;
“The Council” means the Rotorua City Council;
“Minister” means the Minister of Transport and includes any officer, person, or authority acting by or under the direction or authority of the Minister.
- There is hereby granted to the Council for a period of 21 years from the commencement of this order, the control of waters described in the First Schedule to this order, subject to the provisions of section 8A of the Act, and to the conditions specified in the Second Schedule to this order.
FIRST SCHEDULE
ALL the waters of Lake Rotorua extending 66 ft from the margin of the lake at its ordinary level and commencing at the easternmost corner of Kawaha 3G in Block XIII, Rotoiti Survey District, and proceeding south-easterly generally along the margin of the lake to the west bank of the Puarenga Stream.
SECOND SCHEDULE

Her Majesty or the Governor-General and all officers in the Government service acting in the execution of their duty shall, at all times, have free ingress, passage, and egress into, through, over, and out of the waters described in the First Schedule to this order without payment.

Nothing herein contained shall authorise the Council to do, or cause to be done, anything repugnant to, or inconsistent with, any law relating to the Customs, or with any regulation of the Minister of Customs, or with any provision of the Harbours Act 1950 or its amendments, or any regulations made thereunder that are, or may hereafter be, in force.

No authority conferred by this Order in Council shall be exercised by the Council in respect of waters now or hereafter used for hydro-electric installations, except with the approval of the New Zealand Electricity Department.

Subject to the provisions of section 8A of the Act, the Council for and within the area of the waters described in the First Schedule hereto—
(a) May by bylaw, do anything which a harbour board may do by bylaw under section 232 of the Act;
(b) May appoint officers and define or limit their powers or duties;
(c) Shall have all the powers, functions, duties, and authorities of a harbour board under the Act as if it were constituted a harbour board;
(d) May expend money out of its general fund or account for the purpose of exercising and performing the control, powers, functions, duties, and authorities conferred by this Order in Council.

Bylaws made by the Council under the authority of this Order in Council shall not come into force until they have been approved by the Minister, by notice in the Gazette.

The said rights, powers, privileges, control, functions, duties, and authorities may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the Council 6 calendar months' notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the last known address of the Council in New Zealand.

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council hereby directs the sale of the land described in the Schedule hereto, such land being no longer required for the purpose for which it was acquired.

WELLINGTON LAND DISTRICT
ALL that piece of land containing 32.03 perches situated in Block 1, Paekakariki Survey District, being part Section 3, Wainui District, and being also Lot 32, D.P. 10231. All certificate of title, Volume 844, folio 74, Wellington Land Registry.
