Boundaries of the County of Whakatane and the Borough
of Whakatane Altered

ORDER IN COUNCIL
At the Government Buildings at Wellington this 10th day of
March 1975
Present:
THE RIGHT HON. W. E. ROWLING PRESIDING IN COUNCIL
PURSUANT to the Local Government Act 1974 and the Local
Government Commission Act 1967 (to the extent that it
continues in force in relation to this order), His Excellency
the Governor-General, acting by and with the advice and
consent of the Executive Council, hereby makes the follow-
ing order.
ORDER
- This Order shall come into effect on 1 April 1975.
- The boundaries of the districts of Whakatane County
and Whakatane Borough are hereby altered by excluding
from the district of Whakatane County and including in
the district of Whakatane Borough the areas described
in the Schedule hereto. - So far as they are applicable and with the necessary
modifications the provisions of section 99A of the Land
Transfer Act 1952 shall apply to the alteration of boundaries
herein provided. - Except as otherwise provided herein or in the Local
Government Commission Act 1967 (to the extent that it
continues in force in relation to this Order), the provisions
of the Municipal Corporations Act 1954 shall apply as
appropriate to the alterations of boundaries herein provided.
SCHEDULE
ADDITIONS TO WHAKATANE BOROUGH
FIRSTLY, all that area in the South Auckland Land District,
Whakatane County, bounded by a line commencing at a
point on the right bank of the Whakatane River being the
north-eastern corner of Part Allotment 238, Waimana Parish,
situated in Block I, Whakatane Survey District, and proceed-
ing north-westerly along a right line to a point on the
left bank of the said river being the south-eastern corner
of the western portion of Part Lot 4, D.P. 21268; thence
generally north-westerly along the south-western side of
State Highway 2 to a point in line with the north-western
boundary of Part Allotment 28B3C4, Rangitaiki Parish;
thence north-easterly to and along that boundary to the
southern boundary of a Drain Reserve by Gazette, 1927,
page 1370; thence easterly along that boundary to the
north-western side of Keepa Road; thence generally north-
easterly along that side and its production to the south-
eastern corner of a Drain Reserve by Gazette, 1940, page
1572; thence generally north-westerly along the south-western
boundary of the said reserve and the right bank of the
Orini River to a point in line with the eastern boundary
of Allotment 28B1B1A, Rangitaiki Parish, situated in Block
IA, Whakatane Survey District; thence northerly to and
along that boundary to the sea coast; thence generally
south-easterly along the sea coast and the left bank of
the Whakatane River to a point due west of the south-
western corner of Lot 1, D.P. 20477 situated in Block II,
Whakatane Survey District; thence due easterly along a
right line to the boundary of the Whakatane Borough as
described in New Zealand Gazette, 1970, page 197; thence
south-westerly along that boundary to the point of com-
mencement.
Secondly, all that area in the South Auckland Land
District, Whakatane County, bounded by a line commencing
at the north-western corner of Part Lot 1, D.P. 29191,
situated in Block II, Whakatane Survey District, and pro-
ceeding easterly along the northern boundary of the said
Part Lot 1; thence generally southerly along the generally
eastern boundaries of the said Part Lot 1 and Lot 2,
D.P. S. 2301 to the south-eastern corner of the said Lot 2;
thence north-westerly along the south-western boundaries of
the said Lot 2 and Lot 3, D.P. S 2301 and the last-
mentioned boundary produced across Bay View Road to
the right bank of the Whakatane River; thence north-
easterly along that bank to the point of commencement.
Thirdly, all that area in the South Auckland Land District,
Whakatane County, bounded by a line commencing at the
western corner of Allotment 273, Waimana Parish, situated
in Block II, Whakatane Survey District, as shown on S.O.
Plan 34148, and proceeding south-easterly and north-easterly
along the south-western and south-eastern boundaries of
that allotment to its eastern corner: thence south-easterly
along the north-eastern boundaries of Lot 1, D.P. S. 4616,
and Part Lot 1, D.P. 25400, to the easternmost corner of
the last-mentioned lot; thence south-westerly and north-
westerly along the south-eastern and south-western bound-
aries of that lot to the south-eastern side of Bay View
Road; thence north-easterly along that side to the point
of commencement.
Fourthly, all that area in the South Auckland Land
District, Whakatane County, bounded by a line commencing
at the south-western corner of Lot 1, D.P. S. 10326, situated
in Block II, Whakatane Survey District, and proceeding
generally north-easterly along the south-western boundaries
of that Lot and Lot 316, D.P. S. 10326, the south-eastern
boundaries of Lots 65 and 66, D.P. S. 10444, the end of
White Horse Drive, the south-eastern boundaries of Lots 72
and 74, D.P. S. 10444, and Lots 75 to 77 and 89, D.P. S. 13088,
and the last-mentioned boundary produced to the south-
western side of Whakatane-Ohope Road; thence south-
easterly along that side to Peg 1 (N) as shown on S.O.
Plan 38484; thence generally south-westerly along a series
of right lines; bearing 170° 30', distance 164 metres; 234° 00',
141 metres; 273° 00', 60 metres; 234° 00', 45 metres; and
304° 30', 54 metres to the generally eastern boundary of
Allotment 553, Waimana Parish; thence generally northerly
and north-westerly along the generally eastern and north-
eastern boundaries of the said Allotment 553 to the point
of commencement.
Fifthly, all that area in the South Auckland Land District,
Whakatane County, bounded by a line commencing at a
point in the middle of Whakatane River in line with the
south-eastern boundary of Lot 1, D.P. S. 10213, situated
in Block I, Whakatane Survey District, and proceeding
north-easterly along the production of the said boundary
to the mean high-water line of the right bank of the said
river; thence generally south-easterly along the said water
line and the mean high-water line of the right bank of
the old course of the said river to the south-western side
of Bridge Street; thence north-westerly along a right line
being the production of that side to the middle of the
old course of the Whakatane River; thence generally south-
westerly along the middle of the said old course to the
middle of the new course of the said river; thence north-
westerly along the middle of the said new course to the
point of commencement.

THE HON. R. J. TIZARD PRESIDING IN COUNCIL
PURSUANT to the Local Government Act 1974 and the Local
Government Commission Act 1967 (to the extent that it
continues in force in relation to this order), His Excellency
the Governor-General acting by and with the advice and
consent of the Executive Council, hereby makes the following
order.
ORDER - This order shall come into effect on 1 April 1975.
- The area described in the Schedule hereto shall be
excluded from the district of Matamata County and included
in the district of Matamata Borough.
SCHEDULE
ALL that area in the South Auckland Land District, Matamata
County, bounded by a line commencing at the easternmost
corner of Section 110, Matamata Settlement, situated in
Block II, Tapapa Survey District, being a point on the
