No. 81

  1. Except as provided in clause 12 hereof, for the period specified in clause 4, the council of the said county (hereinafter referred to as the “said council”) shall consist of 10 members, of whom 5 shall be elected by the electors of the Geraldine Division and 5 by the electors of the Levels Division.

  2. For the divisions hereinbefore prescribed, the ridings of the said county and representation of the ridings on the said council shall be as follows:

(a) Geraldine Division

Ridings Membership

(i) Mount Peel - Rangitata Riding comprising the sum of the areas of the Mount Peel and Rangitata Ridings of the Geraldine County ………………………………………… 1 member

(ii) Temuka Riding comprising the sum of the areas of the Temuka and Waitohi Ridings of Geraldine County ………………………………………… 2 members

(iii) Geraldine Riding comprising the sum of the areas of the Geraldine and Kakahu Ridings of Geraldine County ………………………………………… 2 members

(b) Levels Division

(i) Tengawai Riding comprising the area of the Tengawai Riding of Levels County ………………………………………… 1 member

(ii) Point Riding comprising the area of the Point Riding of Levels County ………………………………………… 1 member

(iii) Seadown Riding comprising the area of the Seadown Riding of Levels County ………………………………………… 1 member

(iv) Hadlow Riding comprising the sum of the areas of the Waimataitai and Claremont Ridings of Levels County ………………………………………… 1 member

(v) Otipu Riding comprising the area of the Otipu Riding of Levels County 1 member

Subject to the provisions of clause 9 nothing provided in clause 10 hereof shall operate to prevent the said council from redefining from time to time the ridings of each division or rearranging the representation of the riding members of each division in accordance with the provisions of the Counties Act 1956.

  1. The first election of members of the said council shall be held on the date fixed for the triennial general election of members of county councils to be held in October 1974 pursuant to the provisions of the Local Elections and Polls Act 1966.

  2. Until the said council elected at the October 1974 triennial elections takes office the council shall consist of:

(a) The 9 members representing the ridings of the former Geraldine County;

(b) The 8 members representing the ridings of the former Levels County.

  1. For the purposes of sections 60 and 61 of the Counties Act 1956, the person appointed to make up rolls of electors of the several ridings of the said county shall be the county clerk of the former Geraldine County who shall also be responsible for convening the first meeting of the interim council which shall at that meeting elect one of its members to be the interim chairman.

  2. All valuation rolls, other rolls, and lists and rate records in force within the areas comprising the said county shall be deemed to be the valuation rolls, other rolls and lists and rate records of the said county until new valuation rolls, other rolls, and lists and rate records are made for the said county and any action or procedure commenced or in progress in respect of the preparation of those rolls and lists and not completed by the date this order comes into force may be continued and completed by the said council, and on completion of the said rolls and lists these records shall be the rolls and lists of the said county.

  3. The transfer of any members of the staffs of the former Geraldine and Levels County Councils to the service of the said council shall be deemed to be transfers of permanent employees within the meaning of section 4 of the Local Authorities (Employment Protection) Act 1963, and the provisions of that Act shall, with any necessary modifications, apply accordingly.

  4. So far as they are applicable and with the necessary modifications the provisions of section 99A of the Land Transfer Act 1952 shall apply to the union hereby effected.

  5. Except as otherwise provided herein the provisions of section 10 of the Counties Act 1956 shall apply to the union of the counties hereby effected as if the former counties of Geraldine and Levels had been united under that Act.

Alteration of Boundaries of Mackenzie County and Levels County

ORDER IN COUNCIL

At the Government House at Wellington this 26th day of August 1974

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 11 of the Counties Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order shall come into effect on 26 August 1974.

  2. The area described in the Schedule hereto shall be excluded from the Albury Riding of the Mackenzie County and included in the Point Riding of Levels County.

SCHEDULE

ALL those areas in the Canterbury Land District, Mackenzie County, containing 25 acres 1 rood 30 perches, more or less, being:

Firstly, all that area containing 3 roods and 30 perches, more or less, bounded by a line commencing at the southernmost corner of Rural Section 36989, Block IX, Pareora Survey District, and proceeding northerly generally along the eastern side of Cannington Road to the eastern boundary of Rural Section 36989; thence southerly along that boundary to the point of commencement and

Secondly, all that area containing 24 acres and 2 roods, more or less, bounded by a line commencing at the intersection of the southern boundary of Section 71, Rosewill Settlement, with the eastern side of the Cannington Road, Block IX, Pareora Survey District, and proceeding north-easterly generally along the general eastern side of that road and the south-eastern side of Elizabeth Street to the eastern side of Phillip Street; thence south-westerly along right lines of consecutive bearings and distances of 228° 21', 103.0 links; 217° 34', 1581.0 links; 201° 10', 45.0 links; 209° 47', 779.5 links; 198° 01', 648.7 links; 193° 03', 676.3 links, and 238° 05', 292.0 links to the point of commencement.

Alteration of Boundaries of Horowhenua County and Otaki Borough

PURSUANT to the Local Government Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order shall come into force on 1 September 1974.

  2. The area described in the Schedule hereto shall be excluded from the district of Horowhenua County and included in the district of Otaki Borough.

SCHEDULE

WELLINGTON LAND DISTRICT—HOROWHENUA COUNTY

ALL that area of Riverbank Road containing 2.8163 hectares, more or less, situated in Block IX, Waitohu S.D., bounded by a line commencing at the southernmost corner of Lot 8, D.P. 20945, and proceeding south-westerly along a right line to the intersection of the south-western side of Riverbank
