A PROCLAMATION

PURSUANT to the Public Works Act 1928, I, Sir Edward Denis Blundell, the Governor-General of New Zealand, hereby revoke the Proclamation dated 19 September 1972 and published in Gazette, 28 September 1972, No. 78, p. 2019, and registered in the Land Registry Office at Wellington as No. 941205, taking land and an easement of right of way over land for the purpose of oxidation ponds for a sewerage scheme in Blocks IV and VIII, Makotuku Survey District, Borough of Ohakune, in so far as it affects the land described in the Second Schedule thereto, and hereby proclaim and declare that the land described in the First Schedule hereto is hereby taken for the purpose of oxidation ponds for a sewerage scheme and shall vest in the Mayor, Councillors, and Citizens of the Borough of Ohakune as from the date hereinafter mentioned; and I also hereby proclaim and declare that an easement of right of way is hereby taken for the above-mentioned purpose over the land described in the Second Schedule hereto, vesting in the Mayor, Councillors, and Citizens of the Borough of Ohakune (hereinafter called “the Corporation”), as from the date hereinafter mentioned, the full, free, uninterrupted, and unrestricted right, liberty, and privilege for the Corporation, its servants, tenants, agents, workmen, licensees, and invitees (in common with the grantor, his tenants, and any other person lawfully entitled so to do) from time to time and at all times by day and by night to go, pass, and repass, with or without horses and domestic animals of any kind, and with or without carriages, vehicles, motor vehicles, machinery, and implements of any kind, through, over, and along the land described in the said Second Schedule; and I also hereby proclaim and declare that a sewer easement is hereby taken for the above-mentioned purpose over the land described in the Third Schedule hereto, vesting in the Corporation as from the date hereinafter mentioned the rights and powers set out in paragraphs 4 and 5 of the Seventh Schedule to the Land Transfer Act 1952 under the headings “4. Right to Drain Sewage” and “5. Additional Rights Attaching to Easements of Right to Drain Sewage”; and I also declare that this Proclamation shall take effect on and after the 24th day of April 1974.
