Declaring a Leasehold Estate in Land and an Easement over Land Taken for Sanitary Works in Block IX, Whakatane Survey District, Whakatane County

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works and Development hereby declares that, a sufficient agreement to that effect having been entered into, the leasehold estate in the land described in the First Schedule hereto, held from Her Majesty the Queen, by Jean Barr Wardlaw, of Taneatua, married woman, under and by virtue of lease in perpetuity, No. 501, R.B. No. 5C/1280, South Auckland Land Registry, is hereby taken for sanitary works and the right of way easement described in the Second Schedule hereto, is hereby taken for sanitary works over the land described in the Third Schedule hereto, such right of way to be held appurtenant to the land described in the First Schedule hereto; and that both the land and easement shall vest in the Chairman, Councillors, and Inhabitants of the County of Whakatane from and after the 21st day of February 1974.

Description of Easement

THE full and free right, liberty, licence and authority in perpetuity for the Chairman, Councillors, and Inhabitants of the County of Whakatane, to construct and use a right of way, with the right for the corporation’s servants, agents, workmen, licensees, and invitees to go, pass and re-pass, with or without horses, or other animals and vehicles, over and along the land described in the Third Schedule hereto, and to maintain, repair and keep open the said right of way for the purpose of providing access to the land described in the First Schedule hereto.
