DECISION OF THE TRIBUNAL

PREVIOUS issues of Oui have been considered by the Tribunal in October 1973 and in March 1974. On these occasions the issues for May and June 1973, and for February 1974, were found to be indecent in the hands of persons under the age of 18 years, while the issue for July 1973 was declared to be indecent.

The issue now before us, appearing a year later than those originally considered, indicates that the magazine is keeping fairly close to the type of presentation discussed in the first of our earlier decisions (No. 745-7, New Zealand Gazette, 1 November 1973, p. 2259). The presentation of sex for entertainment and amusement, accompanied by fairly lightweight articles and features on other subjects, the particular type of feature which caused the July 1973 issue to be found wholly indecent, is not present in the June 1974 issue. However, the explicit nature of some of the material and the generally indulgent tone of the magazine's approach to sexual matters continue to make it unsuitable for younger readers.

The Tribunal accordingly classifies Oui, Vol. 3, No. 6, June 1974, as indecent in the hands of persons under the age of 18 years.

Price Order No. 2300 (Californian Oranges)

PURSUANT to the Control of Prices Act 1947, I, Maurice John Belgrave, pursuant to a delegation from the Secretary of Trade and Industry acting under a delegation from the Price Tribunal, hereby make the following price order:

  1. This order may be cited as Price Order No. 2300, and shall come into force on the 9th day of December 1974.

  2. (1) Price Order No. 2280* is hereby revoked.

(2) The revocation of the said order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this order.

  1. References in this order to metropolitan areas are references to the metropolitan areas described in the Schedule hereto.

APPLICATION OF THIS ORDER

  1. This order applies with respect to all Californian oranges sold by way of retail in New Zealand.

MAXIMUM RETAIL PRICES OF CALIFORNIAN ORANGES

  1. (1) The maximum price that may be charged or received by any retailer for Californian oranges to which this order applies shall be:

(a) When sold by a retailer carrying on business in any of the metropolitan areas of Auckland, Wellington, Christchurch, or Dunedin, or in any of the Cities or Boroughs of Whangarei, Takapuna, Hamilton, Tauranga, Rotorua, Gisborne, New Plymouth, Stratford, Hawera, Wanganui, Palmerston North, Napier, Hastings, Masterton, Blenheim, Nelson, Greymouth, Timaru, Westport, Oamaru, Balclutha, Gore, or Invercargill—

28 cents per lb.

(b) When sold by a retailer carrying on business elsewhere—

1 lb, 29 cents;
2 lb, 57 cents;
3 lb, 86 cents;
4 lb, $1.14;
5 lb, $1.43;
6 lb, $1.71.

Fractions of a pound shall be calculated at the rate of 29 cents per pound. Quantities in excess of 6 lb shall be calculated at the rate of 28½ cents per pound.

(2) If in respect of any lot of oranges sold by a retailer the maximum price calculated in accordance with the foregoing provisions of this clause is not an exact number of cents, the maximum price of the lot may be computed to the nearest whole cent.

PROVISIONS FOR SPECIAL PRICES

  1. Notwithstanding anything to the contrary in the foregoing provisions of this order, and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any retailer, may authorise special maximum prices in respect of any Californian oranges to which this order applies where special circumstances exist, or for any reason extraordinary charges (freight or otherwise) are incurred by the retailer. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of oranges, or may relate generally to all Californian oranges to which this order applies sold by the retailer while the approval remains in force.

DUTY IMPOSED ON RETAILERS

  1. Every retailer who offers or exposes any Californian oranges for sale in any shop shall keep in a prominent position in such proximity to the oranges to which it relates as to be obviously descriptive thereof, a ticket, placard, or label on which shall be stated in legible and prominent characters the following particulars:

(a) The retail price per pound of the oranges. Retailers to whom clause 5 (1) (b) of this order applies shall state at least the prices for 1 lb and 2 lb lots.

(b) The word "Californian".

Transfer by the Housing Corporation of New Zealand to the Rural Banking and Finance Corporation of Certain Instruments by Way of Security

PURSUANT to section 41 of the Rural Banking and Finance Corporation Act 1974, the Housing Corporation of New Zealand hereby transfers all its interest, rights, and powers under the instruments by way of security, under the Chattels Transfer Act 1924, respectively mentioned in the Schedule hereto, to the Rural Banking and Finance Corporation of New Zealand.
