ORDER

THE nomination of Leonard Roy Hansen as a candidate for the office of councillor to represent the Purerua Riding of the Bay of Islands County at the local authority triennial elections held on 12 October 1974, is hereby validated and shall be deemed, for the purposes of subsection (3) of section 13 of the Local Elections and Polls Act 1966, to have been duly lodged with or given to the returning officer at Kawakawa, notwithstanding that the said nomination, which was received by the Kawakawa Post Office at 10.30 a.m. on Friday, the 13th day of September 1974 (being nomination day), was not received by that returning officer until the morning of Monday, the 16th day of September 1974.

Commission of Inquiry into Harbour Pilotage

ORDER IN COUNCIL

To all to whom these presents shall come, and to:

ALAN AYLMER COATES, Esquire, of Auckland, Retired Stipendiary Magistrate;
JAMES BRIAN McGOWAN, Esquire, of Dunedin, Company Director; and
GERALD ANTHONY PALLETT, Esquire, of Wellington, Marine Insurance Assessor and Nautical Surveyor:

GREETING:

WHEREAS it is desirable that inquiry should be made into the New Zealand harbour pilotage system and matters incidental thereto:

Now, therefore, pursuant to the Commissions of Inquiry Act 1908, I, Sir Edward Denis Blundell, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby appoint you, the said Alan Aylmer Coates, James Brian McGowan, and Gerald Anthony Pallett to be a Commission to inquire into and report uponβ€”

(a) The working of the present pilotage system in New Zealand, including the appointment and employment of pilots by Harbour Boards:

(b) The need, if any, for any changes in any aspect of the present pilotage system, and the legislation under which it operates:

(c) The practicability of the establishment of a New Zealand pilotage service alternative to the present pilotage system (where appropriate having regard to existing systems overseas) and, if it were to be established, its form and the appointment, licensing, engagement or employment of pilots under such a service:

(d) Any associated matters that the Commission may deem to be relevant to the general objects of the inquiry.

And, with the like advice and consent, I do hereby appoint you, the said Alan Aylmer Coates, to be the Chairman of the said Commission:

And for the better enabling you to carry these presents into effect you are hereby authorised and empowered to make and conduct any inquiry under these presents, in accordance with the Commissions of Inquiry Act 1908, at such times and places as you think expedient, with power to adjourn from time to time and place to place as you think fit, and so that these presents shall continue in force and the inquiry may at any time and place be resumed although not regularly adjourned from time to time or from place to place:

And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose, except to me in pursuance of these presents or by my direction, the contents or purport of any report so made or to be made by you or any evidence or information obtained by you in the exercise of the powers hereby conferred upon you except such evidence or information as is received in the course of a sitting open to the public:

And it is hereby declared that the powers hereby conferred shall be exercisable notwithstanding the absence at any time of any one of the members hereby appointed so long as the Chairman, or a member deputed by the Chairman to act in his stead, and one other member are present and concur in the exercise of the powers:

And it is hereby further declared that you have liberty to report your proceedings and findings under this Commission from time to time if you shall judge it expedient so to do:

And, using all due diligence, you are required to report to me in writing under your hands not later than the 23rd day of May 1975 your findings and opinions on the matters aforesaid, together with such recommendations as you think fit to make in respect thereof.

PURSUANT to section 35 of the Defence Act 1971, His Excellency the Governor-General has approved the following appointments, promotions, extensions, transfers, resignations, and retirements of officers of the Royal New Zealand Air Force:

Appointments

Flight Lieutenant R. M. Bulger to be acting Squadron Leader with effect from 26 August 1974 and temp. Squadron Leader with effect from 9 September 1974.

Flight Lieutenant T. K. Butler, D.F.C., is appointed to a career commission for a period to expire on 25 June 1985, with effect from 10 July 1974.

Promotions

Air Commodore R. B. Bolt, C.B.E., D.F.C., A.F.C., to be Air Vice-Marshal, with effect from 8 September 1974.

Flight Lieutenant R. J. Lorigan to be Squadron Leader with seniority and effect from 24 September 1974.

Flying Officer B. W. Payne to be Flight Lieutenant with seniority and effect from 11 September 1974.

Flying Officer P. S. Faulkner, B.Sc., to be Flight Lieutenant with seniority from 12 June 1972 and effect from 24 September 1974.

Extension of Commissions

The short-service commission of Flight Lieutenant R. C. Andrews is extended to 11 January 1979, followed by 4 years on the Reserve of Air Force Officers.

The short-service commission of Flight Lieutenant B. R. Francis is extended to 30 March 1979, followed by 4 years on the Reserve of Air Force Officers.

Resignation of Commission

Flying Officer Warwick Nisbet Smith resigns his commission with effect from 3 August 1974.

Cancellation of Commissions

The commission of Acting Pilot Officer Stanley Raymond Muir is cancelled with effect from 15 July 1974.

The commission of Acting Pilot Officer Wayne Thomas Pearson is cancelled with effect from 1 June 1974.

Transfers to Reserve

Flight Lieutenant Anthony James Menzies is transferred to the Reserve of Air Force Officers for a period of 4 years with effect from 31 July 1974.

Flight Lieutenant Colin Pitts Harris is transferred to the Reserve of Air Force Officers for a period of 4 years with effect from 31 July 1974.
