presented. The treatment of sex and violence where these
subjects occur is likely to have ill-effects upon children and
these books would therefore warrant some form of restriction.

Dopin Dan, Mother's Oats, Tales of Amorkins, and Merton
of the Movement are concerned mainly with sub-cultures,
some of them associated with drugs. The sexual content
is minimal and lacks the blatancy of other comics in this
set. Indeed there is little which could be considered harmful
to the more mature reader. However, the crudity of language
along with one or two frames depicting or suggesting sexual
activity and some frames depicting the administration of drug
dosages could have detrimental effects on the young.

The latter two groups of books could, if it were possible,
be allowed restricted circulation. The Tribunal however, is
not free to impose restrictions on the circulation of comic
books when they are likely to be read by children.

Section 2 (3) of the Act states:

"When the Tribunal decides that a picture-story book
likely to be read by children is indecent in the hands of
children under a specified age that picture-story book shall
be deemed to be indecent in the hands of all persons."

As these books clearly fall into this category the Tribunal
has no alternative but to classify all these comic books as
indecent.

The Tribunal classifies each of these 20 comic books as
indecent.

Decision of the Indecent Publications Tribunal

In the matter of the Indecent Publications Act 1963, and
in the matter of a reference to the Tribunal under section 12
(1) of the said Act by the Magistrate's Court at Wellington
for a decision and report in terms of the said section in
respect of the book Oh, Copenhagen by Jerry Yulsmain,
published by Lancer Books, New York.

Mr Drury, solicitor, appeared on behalf of the Collector
of Customs and made submissions. Mr Taylor, a party to
the Court proceedings, appeared and made submissions.

DECISION AND REPORT

Oh, Copenhagen

This book claims to be a photo-documented survey of
Danish culture and mores today, with particular emphasis
on Copenhagen's legal and flourishing pornography industry
and includes interviews with writers, artists, teachers, and
men and women who are engaged in the pornography show
business in Copenhagen.

Many of the photographs are explicit and display sexual
encounters with great detail. They are of group sexual orgies
in pornography clubs, of shots from films, and of advertisements on public display in Copenhagen.

The book lacks an honesty of purpose and is written in
a manner which is offensive and indecent within the meaning
of the Act. The explicit nature of the photographs also
constitutes another sound reason for the decision of the
Tribunal.

The Tribunal classifies this book as indecent.

PURSUANT to powers delegated to me by the Comptroller
of Customs under section 9 of the Customs Act 1966 and
pursuant to section 32 of the Customs Act 1966, I, Colin
Martin McLaren, the Collector of Customs, Nelson, hereby
appoint the place described in the First Schedule hereto
to be a place for the examination of goods subject to the
control of Customs, and hereby revoke the appointment*
of the place described in the Second Schedule hereto as an
