HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to the Reserve Bank of New Zealand Act 1964, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council hereby appoints The Honourable Arnold Henry Nordmeyer of Wellington, as a director of the Reserve Bank of New Zealand, to hold office during pleasure for a term of 3 years commencing on the 1st day of September 1973. The Lake County Council (Frankton Arm) Waters Control Order 1973
DENIS BLUNDELL, Governor-General ORDER IN COUNCIL At the Government House at Wellington this 20th day of August 1973 Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to section 8A of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
(1) Title and commencement- (i) This order may be cited as the Lake County Council (Frankton Arm) Waters Control Order 1973. (ii) This order shall come into force on the date of its publication in the Gazette.
(2) In this order- "The Act" means the Harbours Act 1950: "The Council" means the Lake County Council: "The Minister" means the Minister of Transport; and includes any officer, person, or authority acting by or under the direction or authority of the Minister.
(3) There is hereby granted to the Council for a period of 21 years from the commencement of this order, subject to the provisions of section 8A of the Act and to the conditions specified in the Second Schedule to this order, the control of the waters specified in the First Schedule to this order.
SCHEDULES FIRST SCHEDULE DESCRIPTION OF WATERS ALL those waters of Frankton Arm, Lake Wakatipu, to the east of a right line drawn from the middle of Cecil Road where it meets the northern lake shore to the north-eastern corner of the Lake Wakatipu Service Reserve (Railway) and southerly and westerly along the eastern and southern boundaries of the said reserve to the southern lake shore.
SECOND SCHEDULE CONDITIONS (1) Subject to the provisions of section 8A of the Act, the Council for and within the area of the waters described in the First Schedule hereto-
(a) May, by bylaw, authorise the laying of moorings, regulate and control the use of any anchorage (enclosed or otherwise) for yachts, boats, launches, and other small craft, provide for the proper conduct of the persons using, occupying or frequenting any such anchorage, and fix fees, rents, or payments for moorings and mooring sites;
(b) May appoint a mooring master and define or limit his powers or duties;
(c) May expend money out of its general fund or account for the purpose of exercising and performing the control, powers, functions, duties, and authorities conferred by this Order in Council.
(2) Bylaws made by the Council under the authority of this Order in Council shall not come into force until they have been approved by the Minister, by notice in the Gazette.
(3) The rights, powers, privileges, control, functions, duties, and authorities conferred by or under this Order in Council shall continue to be in force for 21 years from the date of its notification in the Gazette, unless in the meantime such rights, powers, privileges, control, functions, duties, and authorities shall be altered, modified, or revoked by competent authority.
(4) The said rights, powers, privileges, control, functions, duties, and authorities may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the Council 6 calendar months' notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the last known address of the Council in New Zealand. P. G. MILLEN, Clerk of the Executive Council. Amending an Order in Council Appointing a Non-elective Member of the Marlborough Catchment Board DENIS BLUNDELL, Governor-General ORDER IN COUNCIL At the Government House at Wellington this 27th day of August 1973 Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to the Soil Conservation and Rivers Control Act 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 14th day of December 1955 and published in Gazette 15 December 1955, at page 1983, appointing three non-elective members of the Marlborough Catchment Board by deleting “Assistant Conservator of Forests, New Zealand Forest Service, Nelson” and substituting “Principal Forester, New Zealand Forest Service, Nelson”.
