that effect having been entered into, the land described in
the Schedule hereto is hereby taken, subject to the mining
rights created in and by transfer No. 281315, South Auckland
Land Registry, for soil conservation and river control purposes
from and after the 16th day of July 1973; and
(b) further declares the land described in the said Schedule
to be Crown land, for the purposes of the Land Act 1948,
as from the 16th day of July 1973, subject to the said
mining rights.
