Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of a reference to the Tribunal under section 12 (1) of the said Act by the Magistrate’s Court at Lower Hutt for a decision and report in terms of the said section in respect of the following books and magazines: Roommate Wanted, Vol. 1, No. 1, published by Jaybird Enterprises Inc., California; Naked House Parties, No. 1, published by Jaybird Enterprises Inc., California; Queens of the Road by Jack Milton, published by Brandon House, California; New Meat by Mike Carter, published by Brandon House, California; and Juices of Lust by Valerie Smyth-Jones, published by Brandon House, California.

Mr Drury, solicitor, appeared on behalf of the Comptroller of Customs and made submissions. Mr Wallis, a party to the proceedings before the Court, appeared and made submissions.

DECISION AND REPORT

Queens of the Road, New Meat, Juices of Lust

These three Brandon House paperback novels of American origin are solely vehicles for depicting sexual perversions. The plots and characterisations are woefully weak. The sexual encounters are coarsely described and of gross indecency.

The Tribunal classifies these three books as indecent.

Roommate Wanted, Vol. 1, No. 1,
Naked House Parties, No. 1

These two paperback productions of photographs with stories can be distinguished by the fact that the former has more text as a proportion of the whole and the latter has only brief insets with the photographs. However the text in Naked House Parties does not correlate very well with the photographs and both productions have a heavy emphasis on group sex and lesbianism. They appear to be designed to appeal to prurient tastes and possess no redeeming features of literary merit or social significance.

The Tribunal classifies these books as indecent.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by Granada Publishing Ltd. of London for a decision in respect of the book The Square Root of Sex by Ted Mark, published by Granada Publishing Ltd.

Mr Heron, solicitor, appeared on behalf of the applicant and made submissions.

DECISION OF THE TRIBUNAL

This paperback novel tells the story of two scientists who conduct a research project on erotic human behaviour. The accounts of some of the sexual exploits studied make the book unsuitable for young persons but it does not dwell unduly on prurient detail, nor employ obscene language. The book has literary merit and the dominant effect is a rather laboured satire on scientific method but it is not devoid of some humour. We see no grounds for denying it to mature readers.

The Tribunal classifies this book as indecent in the hands of persons under the age of 18 years.
