  1. For the purpose of representation only, the district of the City of Porirua herein prescribed shall, for a period of 10 years, be divided into three wards as follows:

(a) The Pukerua Bay Ward, comprising the area described in the Fifth Schedule hereto;

(b) The Taupo Ward comprising the area described in the Fourth Schedule hereto; and

(c) The Porirua City Ward, comprising the areas described in the Seventh Schedule hereto.

  1. Notwithstanding the provisions of paragraph (e) of section 4 of the Municipal Corporations Act 1954 nothing contained herein shall operate to prevent the Porirua City Council, pursuant to section 23 of the Municipal Corporations Act 1954, from subdividing the area described herein as the Porirua City Ward into further wards, not exceeding five in number, for the period specified in clause 4 of this order.

  2. Nothing herein provided shall operate to prevent the Council of the City of Porirua from continuing a ward system for representation purposes beyond the period hereinbefore prescribed in accordance with the provisions of section 23 of the Municipal Corporations Act 1954.

  3. For the purposes of finance the City of Porirua herein prescribed shall, for a period of not less than 5 years nor more than 10 years, be divided into two divisions to be known as:

(a) Taupo - Pukerua Bay Division, comprising the areas described in the Fourth and Fifth Schedules hereto; and

(b) Porirua Division, comprising the areas described in the Seventh Schedule hereto.

  1. The provisions of the Municipal Corporations Act 1954 in respect of ward rating, finance, and accounts shall, with any necessary modifications, apply to the above divisions as if they were wards of the City of Porirua.

  2. (a) The system of rating shall be on the basis of the unimproved or land values as the case may be.

(b) Until such time as a revised valuation of the whole of the city herein prescribed shall come into effect the provisions of the Rating Act 1967 shall, where applicable and with the necessary modifications, apply to the said city as if, for the purposes of Part IX of the said Act, the city were a “special purpose authority” and as if each of the areas described in the First, Second, Third, Fourth, Fifth, and Sixth Schedules hereto, and the City of Porirua as described in Gazette, 1968, p. 2123, were a “constituent district” within the provisions of the said Act.

  1. For such period as the wards specified in clause 4 of this order are maintained, the Council of the City of Porirua shall comprise 15 members, exclusive of the Mayor, and ward representation shall be as follows:

Pukerua Bay Ward ..... ..... 1 member
Taupo Ward ..... ..... 2 members
Porirua City Ward ..... ..... 12 members

  1. The first election of the Council referred to in clause 10 of this order shall be held on the date fixed for the next triennial general election of members of local authorities pursuant to the provisions of the Local Elections and Polls Act 1966.

  2. Until the members of the Council of the City of Porirua come into office following the triennial general election referred to in clause 11 of this order, the Council of the said city shall comprise the Mayor of the City of Porirua and 15 councillors as follows:

(a) One councillor to represent the Pukerua Bay Ward who shall be the member of the Hutt County Council representing the Pukerua Bay Riding of Hutt County and holding office immediately prior to the date on which this order takes effect;

(b) Two councillors to represent the Taupo Ward of whom one shall be the councillor of the Hutt County Council elected to represent the Taupo Riding of Hutt County and holding office immediately prior to the date on which this order takes effect, and the other shall be a member of the Plimmerton/Paremata County Town Committee holding office immediately prior to the said date who shall be appointed by the Hutt County Council on the nomination of the said County Town Committee; and

(c) Twelve councillors to represent the Porirua City Ward who shall be the 12 councillors of the Porirua City Council holding office immediately prior to the date on which this order takes effect.

  1. On the coming into effect of this order, the Plimmerton Urban Fire District shall be abolished and the areas described in the Fourth and Fifth Schedules hereto shall be included in the Porirua United Urban Fire District.

  2. Upon the alteration of the boundaries of the Porirua United Urban Fire District as herein provided, the membership of the Porirua Fire Board shall be increased to seven members with representation as follows:

(a) One member to be elected by the fire brigades in the Porirua United Urban Fire District, in accordance with the rules approved by the Minister of Local Government;

(b) Three members to represent the contributing local authorities of the Porirua United Urban Fire District to be elected as follows:

(i) Two members by resolution of the Porirua City Council; and

(ii) One member by resolution of the Tawa Borough Council.

(c) Three members to represent insurance companies carrying on business in the Porirua United Urban Fire District to be elected in accordance with section 29 of the Fire Services Act 1972.

  1. Until the members of the Porirua United Urban Fire District come into office following the next election of members of fire boards and fire committees held pursuant to subsection (1) of section 28 of the Fire Services Act 1972, the said Board shall comprise the members of the Porirua Fire Board holding office immediately prior to the date on which this order takes effect; and

(a) One further member to be appointed by the Porirua City Council to represent the constituent local authorities within the Porirua United Urban Fire District hereby constituted; and

(b) One further member to represent the insurance companies carrying on business in the Porirua United Urban Fire District to be elected in accordance with section 29 of the Fire Services Act 1972.

  1. The following Orders in Council are hereby revoked:

(a) Order dated 31 March 1958 and published in the Gazette on 2 April 1958 at page 415.

(b) Order dated 30 January 1963 and published in the Gazette on 7 February 1963 at page 145.

  1. The transfer of any members of the staff of the Hutt County Council to the service of the Porirua City Council in terms of the agreement with the Councils of the Cities of Wellington, Lower Hutt, Upper Hutt, Porirua, and the County of Hutt shall be deemed to be transfers of permanent employees within the meaning of section 4 of the Local Authorities (Employment Protection) Act 1963 and the provisions of that Act shall, with any necessary modifications, apply accordingly.

  2. So far as they are applicable and with the necessary modifications the provisions of section 99A of the Land Transfer Act 1952 shall apply to the alteration of boundaries herein provided.

  3. Except as otherwise provided herein or in the Local Government Commission Act 1967 the provisions of the Municipal Corporations Act 1954 shall apply to the alteration of boundaries herein provided.

FIRST SCHEDULE

ALL that area in the Wellington Land District containing 3.4 square miles, more or less, being portion of the County of Hutt and reclamations bounded by a line commencing at a point on the mean high-water mark of the sea in line with the north-eastern boundary of Lot 1, Plan B/271, in Block V, Belmont S.D., and proceeding generally easterly along the generally north-eastern boundaries of the said Lot 1 to the southernmost corner of Section 40, Ohariu District; thence northerly along the boundaries of the City of Porirua as described in Gazette, 1968, p. 2123, to the mean high-water mark of the sea and south-westerly along that high-water mark to the point of commencement.

SECOND SCHEDULE

ALL that area in the Wellington Land District containing 1.2 square miles, more or less, being portion of the County of Hutt bounded by a line commencing at the northernmost corner of Lot 1, D.P. 9126, in Block V, Belmont S.D., and proceeding southerly along the western boundary of the said Lot 1 to the northernmost corner of Lot 1, D.P. 11219; thence generally easterly along the north-eastern boundary of the said Lot 1, a right line across Ohariu Valley Road to and along the north-eastern boundaries of Lots 11 and 12, D.P. 27582, and the north-western and northern boundaries
