Boundaries of County of Hutt and City of Upper Hutt Altered

PURSUANT to the Local Government Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

1. This order shall come into effect on 1 April 1973.

2. The boundaries of the County of Hutt and the City of Upper Hutt shall be altered by excluding from the district of the said county and including in the district of the said city the areas described in the First and Second Schedules hereto.

3. For the purpose of representation only, the district of the City of Upper Hutt herein prescribed shall, for a period of 10 years, be divided into three wards as follows:

(a) The Rimutaka Rural Ward, comprising the area described in the First Schedule hereto;

(b) The Rimutaka Urban Ward, comprising the area described in the Second Schedule hereto; and

(c) The Upper Hutt City Ward, comprising the area described in the Third Schedule hereto.

4. Notwithstanding the provisions of paragraph (e) of section 4 of the Municipal Corporations Act 1954, nothing contained herein shall operate to prevent the Upper Hutt City Council, pursuant to section 23 of the Municipal Corporations Act 1954, from subdividing the area described herein as the Upper Hutt City Ward into further wards, not exceeding five in number, for the period specified in clause 3 of this order.

5. Nothing herein provided shall operate to prevent the Council of the City of Upper Hutt from continuing a ward system for representation purposes beyond the period hereinbefore prescribed in accordance with the provisions of section 23 of the Municipal Corporations Act 1954.

6. For the purpose of finance the City of Upper Hutt herein prescribed shall, for a period of not less than 5 nor more than 10 years, be divided into two divisions to be known as:

(a) Rimutaka Rural Division, comprising the areas described in the First Schedule hereto; and

(b) Upper Hutt Urban Division, comprising the areas described in the Second and Third Schedules hereto.

7. The provisions of the Municipal Corporations Act 1954 in respect of ward rating, finance, and accounts shall, with any necessary modifications, apply to the above divisions as if they were wards of the City of Upper Hutt.

8. (a) The system of rating shall be on the basis of the unimproved or land values as the case may be.

(b) Until such time as a revised valuation of the whole of the city herein prescribed shall come into effect the provisions of the Rating Act 1967 shall, where applicable and with the necessary modifications, apply to the said city as if for the purposes of Part IX of the said Act the said city were a “special purpose authority” and as if the area described in each Schedule hereto were a “constituent district” within the provisions of the said Act.

9. For such a period as the wards specified in clause 3 of this order are maintained, the Council of the City of Upper Hutt shall comprise 17 members exclusive of the Mayor, and ward representation shall be as follows:

Rimutaka Rural Ward ..... 1 member
Rimutaka Urban Ward ..... 4 members
Upper Hutt City Ward ..... 12 members

10. The first election of the Council referred to in clause 9 of this order shall be held on the date fixed for the next triennial general election of members of local authorities pursuant to the provisions of the Local Elections and Polls Act 1966.

11. Until the members of the Council of the City of Upper Hutt come into office following the triennial general election referred to in clause 10 of this order, the Council of the said city shall comprise the Mayor of the City of Upper Hutt and 17 councillors, as follows:

(a) One councillor to represent the Rimutaka Rural Ward who shall be elected at an election as hereinafter provided.

(b) Four councillors to represent the Rimutaka Urban Ward, of whom one shall be the member of the Hutt County Council representing the Rimutaka Riding of Hutt County and holding office immediately prior to the date on which this order takes effect, and three shall be elected at an election as hereinafter provided.

(c) Twelve councillors to represent the Upper Hutt City Ward who shall be the 12 councillors of the Upper Hutt City Council holding office immediately prior to the date on which this order takes effect.
