Setting Apart Maori Freehold Land as a Maori Reservation

PURSUANT to section 439 (1) of the Maori Affairs Act 1953,
the Maori freehold land described in the Schedule hereto is
hereby set apart as a Maori reservation for the purpose of a
burial ground for the members of the Ngati Konohi tribe.

Setting Apart Maori Freehold Land as a Maori Reservation

WHEREAS by Order in Council, dated 16 May 1962, and pub-
lished in the New Zealand Gazette, 24 May 1962, No. 32,
p. 796, the land described in the First Schedule hereto was set
apart as a Maori reservation and whereas it is desired to make
amendment to the said Order in Council; now, therefore,
pursuant to section 439 of the Maori Affairs Act 1953, notice
is hereby given as follows.

NOTICE

  1. The reservation, constituted by Order in Council, dated
    16 May 1962, and published in the New Zealand Gazette,
    24 May 1962, No. 32, p. 796, relating to the land described
    in the First Schedule is hereby cancelled.

  2. The whole of the land described in the Second Schedule
    hereto is hereby set apart as a Maori reservation for the
    purpose of a meeting place for the common use of the
    followers of Erueti Te Whiti and Te Tohu Kakahi.

Indecent Publications Tribunal

I, Jack Alexander McLeod Kean, Comptroller of Customs,
give notice that I have applied to the Indecent Publications
Tribunal for a decision as to whether the book described below
is indecent or not, or for a decision as to its classification.
Title: Nude Photography—A Panegyric Photo Essay of
the Female Body.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and
in the matter of an application by the Comptroller of Customs
for a decision in respect of the magazines Penthouse,* pub-
lished by Penthouse Publications Ltd., London.
There was no appearance of the applicant. Mr Heron,
solicitor, appeared on behalf of the publisher’s representative
in New Zealand and made submissions.

DECISION OF THE TRIBUNAL

FOUR issues of the British magazine Penthouse, Vol. 7, Nos.
1 to 4, all published in 1972, have been submitted to us. The
Tribunal has previously considered Penthouse on a number
of occasions, the most recent being Vol. 6, No. 3, earlier this
year. Decision No. 436 classified that issue as not indecent.
On this occasion we are able to deal with a sequence of
four issues rather than a single issue in isolation. Of Vol. 6,
No. 3, the Tribunal said:
"This issue contains serious and informative articles, some
of which deal with subjects on sex, and there are also articles
and illustrations in lighter vein. Taking the issue as a whole
and in spite of some features which some may consider
offensive or in poor taste, the Tribunal has decided to
classify it as not indecent."
As a general description of the four issues now before us,
we consider this is still valid. The balance of material is not,
however, weighted so heavily on the serious and non-sexual
side as we thought earlier; and in contrast to the American
Playboy, for example, some of the figure photographs tend to
be more contrived and suggestive. On further consideration,
therefore, the Tribunal has come to the conclusion that while
Penthouse is not harmful to mature readers, an age restriction
is warranted taking into account the current standards of the
magazine itself measured against what is generally available on
news stands in this country.
The Tribunal accordingly classifies these four issues of
Penthouse (Vol. 7, Nos. 1 to 4) as indecent in the hands of
persons under the age of 18 years.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and
in the matter of an application by the Comptroller of Customs
for a decision in respect of the book Making Love, anonymous,
published by Corgi Books Ltd., London, and in the matter
of an application by Seven Seas Publishing Pty. Ltd. for a
decision in respect of the book Paare, anonymous, published
by Wilhelm Heyne, Germany.
There was no appearance on behalf of the Comptroller of
Customs. Mr Henderson, solicitor, appeared on behalf of the
publisher’s representative in New Zealand of both books and
made submissions.

DECISION OF THE TRIBUNAL
Making Love consists of a black-paged book full of photo-
graphs without captions or text. The poses are grotesque, the
general effect ugly, the whole contrived, and verging on the
obscene.
Paare is also a book of photographs of sexual activity; there
are five sequences by different photographers whose qualities
are detailed in the brief foreword (in German). These sections
vary in type and quality, but there is none of any merit;
grotesque poses, close-ups of fleshy contortions, homosexual
encounter in slow motion, kinky gimmicks, all cater to
prurience.
The Tribunal classifies both these books as indecent.
