Merger of the Electric Supply Districts of the North
Canterbury Electric Power Board and the Rangiora Borough
Council

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Electricity Distribution Commission Act
1967, His Excellency the Governor-General, acting by and
with the advice and consent of the Executive Council, hereby
makes the following order.
ORDER
- INTERPRETATION
In this order, unless the context otherwise requires—
“Board” means the North Canterbury Electric Power
Board.
“Council” means the Rangiora Borough Council.
“Borough consumers” means the consumers of electric
power situated in the Borough of Rangiora.
- MERGER OF DISTRICT
THE licensed area of supply of the Council, as defined in the
Rangiora Borough Council Electric Lines Licence 1960, dated
17 August 1960 and published in the Gazette on 18 August
1960 at p. 1233, is hereby included and merged in the Board’s
electric power district. For the purposes of the Electric Power
Boards Act 1925, this merger shall be deemed also to have
been effected under that Act.
- RIGHTS AND OBLIGATIONS OF SUPPLY AUTHORITY
PURSUANT to section 34 of the Electricity Distribution Commission Act 1967, the Board shall exercise all rights and
undertake all obligations previously exercised by the Council
in carrying on its electricity undertaking.
- REPRESENTATION
(i) On the date of completion, the Borough of Rangiora
shall become a constituent district of the Board which from
that date shall consist of nine members.
(ii) The North Canterbury Electric Power District Representation Order 1965, dated 1 September 1965 and published in
the Gazette on 9 September 1965 at p. 1500, is hereby amended
by adding the following to the Schedule thereto:

(iii) The first representatives of the Borough of Rangiora on
the Board shall be appointed by the Council and shall hold
office until the next triennial local body election. All subsequent
representatives of the Borough shall be elected by the electors
of the Borough of Rangiora.
- PURCHASE PRICE
THE purchase price to be paid by the Board to the Council
for the purchase of the electricity undertaking, property, and
assets, as defined in the Schedule hereto, excepting only motor
vehicles, stock in hand, and tools and equipment, shall be the
sum of $423,000, provided that the said sum of $423,000 shall
be increased by the amount of any capital expenditure incurred
by the Council in respect of the said electricity undertaking,
property, and assets between 19 October 1971 and the date
of completion.
The price to be paid for the purchase of the motor vehicles,
stock in hand, and tools and equipment shall be determined
by agreement between the parties as at the date of completion
and the price when determined shall be added to the purchase
price.
- DISPOSITION OF ASSETS AND LIABILITIES
ON the date of completion the Board shall take over from the
Council the electricity undertaking, property, and assets
described in the Schedule, hereto.
All liabilities of any kind whatsoever incurred by the Council
up to the date of completion shall remain liabilities of the
Council only.
- TARIFFS
(i) Borough consumers shall remain on the Council’s tariff
as at the date of completion for a period of 2 years, after
which the Board’s tariff shall apply to them; provided however
that if during this 2-year period the Board is required to pay to
the New Zealand Electricity Department increased charges for
electricity supplied to it, the Board may then increase the
tariff applying to Borough consumers in order to cover or
recoup such increased charges. Provided also that if it becomes
legally permissible during this 2-year period for the Board to
increase its tariffs, the tariffs applying to Borough consumers
may be increased by the amount by which the Council would
have increased them if not restrained by the provisions of the
Electricity Price Stabilisation Regulations 1972.
(ii) Meter readings for Borough consumers shall remain on
a 2-monthly basis.
(iii) As from the date of completion, the Board shall charge
the Council a special tariff for pumping the Borough water
supply.
- STAFF
THE Board shall continue to employ, as required by the Local
Authori ties (Employment Protection) Act 1963, all persons
permanently employed in the Council’s electricity undertaking
at the date of completion.
- DATE OF COMPLETION
THE date of completion of the sale and purchase shall be 30
June 1972 and the merger shall come into force on that date.
Possession of all property included in the sale and purchase
shall be taken on that date.
SCHEDULE
The whole of the Council’s electricity undertaking for the
supply of electricity to the Borough consumers together with
all the property and assets owned by the Council whether
real or personal and all stock, chattels, and things owned by
the Council, and all rights of all kinds belonging to the
Council in connection with the said electricity undertaking
excluding however the following assets which shall remain the
property of the council, namely:
(1) The Rangiora Borough Council’s Electricity Department’s
Depreciation Fund.
(2) All moneys represented by the credit balance in the
electricity account of the Council’s electricity undertaking.
(3) All debts owing to the Council in respect of its said
electricity undertaking at the date of completion.
