The Motor Launch (Rakaia Lagoon) Notice 1972—Ellesmere County Council

PURSUANT to the Motor Launch Regulations 1962*, the Minister of Marine and Fisheries hereby gives the following notice:
-
(a) This notice may be cited as the Motor Launch (Rakaia Lagoon) Notice 1972.
(b) This notice shall come into force on the 24th day of February 1972, and shall remain in force until further notice. -
Subject to the conditions set forth in the Second Schedule hereto, regulation 11 of the Motor Launch Regulations 1962 shall not apply with respect to the area described in the First Schedule hereto.

FIRST SCHEDULE
ALL that area of water known as Rakaia Lagoon at the mouth of the Rakaia River.

SECOND SCHEDULE
-
No person shall propel or navigate a powered vessel at a proper speed greater than 5 miles an hour when—
(a) Within 100 ft of any other vessel; or
(b) Within 100 ft of any person in the water, or bathing, or fishing; or
(c) Within 100 ft of any buoyed fishing net. -
At each point in the area specified in the First Schedule hereto, where powered vessels are normally launched, there shall be erected a notice board, measuring not less than 2 ft 6 in. by 2 ft, painted bright orange, with black lettering in the following form:
“NOTICE
RAKAIA LAGOON MOTOR LAUNCH REGULATIONS 1962
The following replace regulation 11:
(1) No person shall propel or navigate a powered vessel at a proper speed greater than 5 miles an hour when—
(a) Within 100 ft of any other vessel; or
(b) Within 100 ft of any person in the water, or bathing, or fishing; or
(c) Within 100 ft of any buoyed fishing net.
NOTE—Where less than 400 yd in width: No water skiing.”

Licensing Cecil Raymond Brand and John Charles Austin to Occupy a Site for a Jetty at Whangawehi Stream
———
PURSUANT to the Harbours Act 1950, the Minister of Marine and Fisheries hereby licenses and permits Cecil Raymond Brand and John Charles Austin (hereinafter called the licensees, which term shall include their administrators, executors, or assigns unless the context requires a different construction) to use and occupy a part of the foreshore and bed of the Whangawehi Stream as shown on plan marked M.D. 14421 and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a jetty as shown on the said plan, such licence to be held and enjoyed by the licensees upon and subject to the terms and conditions set forth in the Schedule hereto.
The licence of 17 January 1972* is hereby revoked.

SCHEDULE
CONDITIONS

This licence is subject to the Foreshore Licence Regulations 1960, and the provisions of those regulations shall, so far as applicable, apply hereto.

The term of the licence shall be 14 years from the 1st day of January 1972.

The premium payable by the licensees shall be ten dollars ($10) and the annual sum so payable by the licensees shall be twenty dollars ($20).

Change of Purpose of a Reserve

PURSUANT to the Reserves and Domains Act 1953, the Minister of Lands hereby changes the purpose of the reserve described in the Schedule hereto from a reserve for plantation purposes to a reserve for municipal purposes.

Revocation of the Reservation Over a Reserve Specifying that the Land Shall be Held by the East Coast Bays Borough Council in Fee Simple and How the Value Thereof Shall be Utilised

PURSUANT to the Reserves and Domains Act 1953, the Minister of Lands hereby revokes the reservation as a reserve for recreation purposes over the land described in the Schedule hereto and further declares that the land shall be held by the East Coast Bays Borough Council, in fee simple, provided that a sum equal to the current market value of the said land is paid by the Council into its reserves account, such moneys to be used and applied in or towards the improvement of other recreation reserves under the control of the Council or in or towards the purchase of other land for recreation purposes.
