Declaring a Right of Way Easement in Gross for State Forest Purposes Taken Over a Leasehold Estate in Land in Block I, Gordon Survey District, Waimea County

PURSUANT to section 32 of the Public Works Act 1928 and section 15 of the Forests Act 1949, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, an easement in gross for right of way for State forest purposes is hereby taken over the leasehold estate in the land described in the Schedule hereto held at present from Her Majesty the Queen by Robert Henry Heslop, of Richmond, farmer, under and by virtue of renewable lease of farm land No. 91; recorded in leasehold certificate of title, Volume 122, folio 85, Nelson Land Registry, from and after the 18th day of December 1972, vesting in Her Majesty the Queen the full free uninterrupted and unrestricted right, liberty, licence, and authority for as long as the lease or any lease in substitution shall remain in force for Her Majesty’s grantees, servants, tenants, agents, workmen, licensees, invitees, and any other person lawfully entitled so to do from time to time and at all times for as long as the lease or any lease in substitution shall remain in force, by day and by night to go pass and repass with or without horses and domestic animals of any kind and with or without carriages, vehicles, motor vehicles, machinery, tools, implements, and equipment of any kind over and along the land described in the Schedule hereto and to enter upon the said land and to remain there for any reasonable time for the purpose of construction, laying, repairing, renewing, maintaining, and keeping open the said right of way.
