Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the book Acts of Love by Dr Jan Berghoff, published by Modern Age Design Ltd., London.

There was no appearance of the applicant nor of the publisher's representative in New Zealand. Accordingly no submissions were made.

DECISION OF THE TRIBUNAL

Acts of Love is a collection of 36 photographs of a couple in various positions of sexual intercourse, together with a straightforward explanatory text. It is similar in style and tone to those already passed with minimum restriction by the Tribunal (Decisions 200, 367, 368) but goes further. Described on the cover as "erotic variations to inspire men and arouse women", some of the techniques pictured belong to more advanced (or more primitive) stages of sexual activity and it seems appropriate to restrict this book to adults. It is essentially of a private nature and some of the pictures are acceptable only within the context and intention of the book as a whole; although this must not affect our decision, individual public display of certain pages could constitute an offence against the law.

The Tribunal classifies this book as indecent in the hands of persons under 18 years.

There was no appearance of the applicant nor of the publisher's representative in New Zealand. Accordingly no submissions were made.

DECISION OF THE TRIBUNAL

THIS paperback novel is the rather light-hearted, almost frivolous (and appallingly written) tale of the amatory adventures of a window cleaner. So far do they predominate that one might say window cleaning was his hobby rather than his occupation, and window cleaners would seem to have a greater supply of available and willing women to hand than people in almost any other occupation.

Treated as sheer entertainment this novel is unlikely to corrupt any mature reader; younger readers may be tempted to accord it a greater degree of verisimilitude.

The Tribunal classifies this book as indecent in the hands of persons under the age of 16 years.

There was no appearance of the applicant nor of the publisher's representative in New Zealand. Accordingly no submissions were made.

DECISION OF THE TRIBUNAL

THIS book is introduced as a report on the author's study of one segment of females: social nudists and potential nudists. Its most notable feature is that the participants' responses are given in direct speech. In places the profuse reporting of these responses seems to have left behind analysis of them and to overshadow the presentation of the findings of the study. The nature of some of the behaviour described, the sheer volume of the citations, and their intimacy and explicitness all lead to the view that restriction of the book's circulation is required.

The Tribunal classifies this book as indecent in the hands of persons under 18 years.
