Decision of the Indecent Publications Tribunal
IN the matter of the Indecent Publications Act 1963, and in the
matter of an application by the Secretary for Justice for a
decision in respect of the books The Lure of Postures by Sha
Kokken, M.D., published by Ikeda Publishing Co., Tokyo, and
Helga and Bernd by Holger Benson and Thomas Bengh, published by Stephenson Verlag, Flensburg, West Germany.
There was no appearance of the applicant nor of the
publisher's representative in New Zealand. A written submission
was made by Waverley Publishing Co. Ltd. as representative of
the publisher.
DECISION OF THE TRIBUNAL
These books deal with the technique of sexual intercourse.
They use photographs with an explanatory text. They clearly
fall into the category described in Decision 200 on the Morgens
Toft version of this theme, and in Decision 339 on The
Pictorial Guide by Schwenda and Leucher, in that they are
serious, dignified, and beautiful in treatment.
Because one element in the rejection by the Tribunal of
cruder books on this subject was the fact that the couple in
the photographs wore bikinis (Decision 223), it is perhaps
necessary to comment further. In both the books now under
consideration the two people wear ballet tights. In the case
of the German publication this stylises the positions in a way
which we think unobjectionable. In the Japanese book the
positions are adopted by each person singly and in the manner
of ballet, which gives physical and psychological detachment,
and makes the costume entirely suitable if not essential; for
this reason, the Tribunal considered making no restriction at
all on The Lure of Postures but as its nature, purpose, and
text are as sexually adult as in the other case we decide it
should be classified in the same way.
The Tribunal classifies these books as indecent in the hands
of persons under 16 years unless such persons are being
instructed by parents or professional advisers.

IN the matter of the Indecent Publications Act 1963, and in
the matter of an application by the Comptroller of Customs
for a decision in respect of the book Black Velvet by Joseph
Chadwick, published by New English Library, London.
There was no appearance of the applicant nor of the
publisher's representative in New Zealand. Accordingly no
submissions were made.
DECISION OF THE TRIBUNAL
THIS is yet another novel on the theme of sex and slavery in
the Southern States before the American Civil War; in this
one, a Northerner who inherits a plantation comes, sees,
succumbs for a while, and turns away home.
Sex and brutality have a prominent place in the book, which
is not likely to have any corrupting influence on adult readers.
The frank description of some of the scenes, however, leads
the Tribunal to restrict the book.
The Tribunal classifies this book as indecent in the hands of
persons under the age of 18 years.

Henry Miller, published by Grove Press Inc., New York.
There was no appearance of the applicant nor of the
publisher's representative in New Zealand. Accordingly no
submissions were made.
DECISION OF THE TRIBUNAL
IN this book the attitudes and beliefs which permeate Henry
Miller's imaginative and biographical writings are given more
direct expression in a series of reflections on sex and its meaning
in life. The Tribunal considers that The World of Sex should be treated in the same way as the other works by Henry
Miller that have been submitted and that it is not indecent.
The Tribunal classifies the book as not indecent.

There was no appearance of the applicant nor of the
publisher's representative in New Zealand. Accordingly no
submissions were made.
DECISION OF THE TRIBUNAL
THIS paperback novel is the story of a men's club for which
the initiation ceremony is the making of love to a girl in an
airborne aircraft. The story is absurd and the book is devoid
of literary merit but the Tribunal does not consider there
should be any restriction on it.
The Tribunal classifies the book as not indecent.
