hereby declares that so much of the land described in the
Second Schedule hereto as is not included in the Proclamation
dated the 13th day of June 1929, published in New Zealand
Gazette, No. 46, of the 20th day of June 1929, at pages 1689
and 1690, and registered as No. 1929, Wellington Land
Registry, is hereby taken for street and also hereby declares
that the easement in gross described in the Third Schedule
hereto is hereby taken for street purposes over the land
described in the Fourth Schedule hereto, and also hereby
declares that the said easement in gross described in the Third
Schedule hereto is hereby taken for street purposes over so
much of the land described in the Fifth Schedule hereto as is
not included in the Proclamation dated the 13th day of June

An easement in gross vesting full and free right, liberty, and
licence at all times for the Mayor, Councillors, and Citizens of
the City of Wellington, its servants, agents, and workmen to
enter upon and deposit spoil and create and maintain a batter
for Helston Road on the parcels of land described in the
Fourth and Fifth Schedules hereto, together with full and
free right, liberty, and licence for the Corporation, its servants,
agents, and workmen at all times to enter upon and occupy
the said parcels of land for the purpose of carrying out any
works, repairs, replacements or excavations, or constructions
where the same or any of them may in the opinion of the
Mayor, Councillors, and Citizens of the City of Wellington
be necessary to ensure the safety or full use and enjoyment of
the said road as street.
