Local Authorities Loans Act 1956—General Variation of Conditions of Borrowing

PURSUANT to section 9 (4A) of the Local Authorities Loans Act 1956 (as inserted by section 4 (3) of the Local Authorities Loans Amendment Act 1967), notice is hereby given that the Local Authorities Loans Board, acting with the approval of the Minister of Finance, has determined as follows:

  1. This general determination shall apply to all money which any local authority has received the sanction of the Board to borrow by way of special loan, except money borrowed before the 1st day of October 1971 and except also money borrowed on or after that date pursuant to a sanction that requires repayment to be made by any of the following methods:

(a) Equal or unequal yearly or half-yearly instalments of principal not being equal aggregate instalments of principal and interest;

(b) Lump sum payments on maturity not provided from a sinking fund;

(c) Equal aggregate yearly or half-yearly instalments of principal and interest which instalments are insufficient to provide full redemption on maturity.

  1. The term specified in the appropriate sanction shall be the maximum term for which the money may be borrowed and:

(a) Where the method of repayment is in accordance with clause 4 (a) hereof, the minimum term shall be not less than 10 years;

(b) Where the method of repayment is in accordance with clause 4 (b) hereof, any amounts borrowed for less than 10 years shall not exceed 30 percent of the issue and shall be borrowed for 5 years and/or 6 years.

  1. The rate of interest that may be paid in respect of the money borrowed shall be such as shall not produce to the lender a rate exceeding the appropriate rate for the time being determined by the Local Authorities Loans Board and notified in the New Zealand Gazette.

  2. The money borrowed, together with interest thereon, shall be repaid by any of the following methods of repayment:

(a) By equal aggregate yearly or half-yearly instalments of principal and interest sufficient to provide full redemption on maturity;

(b) By establishing a sinking fund before borrowing the money and by making annual payments thereto at a rate of not less than such amount as would, together with compound interest thereon at 5 percent per annum, provide a fund which would be sufficient to repay the money fully at the end of the maximum term for which it may be borrowed.

  1. No interest, instalment of principal and interest, or payment to a sinking fund shall be paid outside New Zealand or out of loan money.

  2. All sanctions to which this general determination applies shall be varied accordingly.

Setting Apart Maori Freehold Land as a Maori Reservation

PURSUANT to section 439 of the Maori Affairs Act 1953, the Maori freehold land described in the Schedule hereto is hereby set apart as a Maori reservation for the purpose of a meeting place, recreation and sports ground for the common use or benefit of the owners and members of the Ngati Maniapoto tribes and related sub-tribes and to be called “Parewaeono Marae”.
