Tariff, Dairy Board, Liquor Hours, Indecent Publications




Tariff Items 51.01.43, 51.01.44, and 51.01.45 will now take
place in the Boardroom, First Floor, Law Society Building, 26
Waring Taylor Street, Wellington, on Thursday, 7 October
1971, commencing at 10.30 a.m.

  1. The terms of reference are those set out fully in Tariff
    and Development Board Notice No. 202 (New Zealand
    Gazette, dated Thursday, 18 February 1971) which originally
    set the date of the hearing as 6 May 1971. Notice of defer-
    ment was given in Notice No. 222 (New Zealand Gazette, 6
    May 1971).

  2. Any person who has not already tendered evidence and
    wishes to do so should lodge 12 copies of a typewritten state-
    ment of the evidence to be presented under oath at the public
    inquiry, at the Board's office no later than Tuesday, 21 Septem-
    ber 1971. In preparing this evidence the "Notes for Guidance
    of Witnesses" prepared by the Board may be of assistance.
    Copies of these notes may be obtained from the Board's office.

New Zealand Dairy Board Elections 1971—Declaration of
Results

I hereby declare the results of elections of members of the
New Zealand Dairy Board held pursuant to the Dairy Board
Act 1961, to be as follows.

EASTERN WARD

Mr Alfred Lawrence Friis, being the only candidate nomi-
nated for the election as a member for the Eastern Ward, is
declared elected.

WELLINGTON WARD

Mr Bernard Lancelot Ebbett, being the only candidate
nominated for the election as a member of the Wellington
Ward, is declared elected.

NORTHERN WARD

I hereby declare the result of the election in the Northern
Ward which closed at 7 p.m. on Wednesday, 23 June 1971, to
be:

Notice of Varied Hours For Sale of Liquor at the Club Hotel,
Pahiatua

PURSUANT to section 221A (16) of the Sale of Liquor Act 1962,
as inserted by section 3 of the Sale of Liquor Amendment Act
(No. 2) 1967, I, Eric Alderson Missen, Secretary for Justice,
hereby give notice that the Manawatu Licensing Committee on
10 June 1971, made an order that the following hours be fixed
for the opening and closing of the said hotel premises for the
sale of liquor to the public:

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in
the matter of an application by the Comptroller of Customs
for a decision in respect of the book The Tour by Aldo
Lucchesi. Published by the New English Library, London.

There was no appearance of the applicant nor of the pub-
lisher's representative in New Zealand. Accordingly no sub-
missions were made.

DECISION OF THE TRIBUNAL

THIS paperback novel uses a thin narrative about two magazine
writers preparing an exposé of all-inclusive tours as
the opportunity for the portrayal of a variety of sexual
encounters which for some of the tour party are their main
experience of Europe. This portrayal is not as all-inclusive as
the cover promises (“every sexual excess in one wild package”)
and its appeal to prurient interest and excitement will affect
younger readers rather than adults. The book is objectionable
enough in its treatment and tone to justify restricting its
circulation.

The Tribunal classifies the book as indecent in the hands of
persons under the age of 18 years.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963 and in the
matter of an application by the Secretary for Justice for a
decision in respect of the book Her, anonymous. Published by
Lyle Stuart Inc. of New York.

Mr Armstrong appeared on behalf of the Secretary for
Justice but made no submissions.

DECISION OF THE TRIBUNAL

THE Tribunal was not unanimous in its decision.

The majority of the Tribunal comprising Messrs Stuart Perry,
D. M. Wylie, and Mrs Joan Cochran classify the book as
indecent in the hands of persons under the age of 18 years.
The minority comprising Mr S. F. W. Johnston and the Chair-
man (Mr R. S. V. Simpson) classify the book as indecent.

MAJORITY DECISION

Her is not a literary masterpiece but it is skilfully written
and is a good example of the erotic novel. The author’s defence
of his anonymity seems valid, and his purpose is plain: to
“tell a true and simple love story” with explicit physical details
and using (in D. H. Lawrence tradition) the Saxon words in
recounting sexual experience. Such stark treatment of erotic
activity may interest, stimulate, shock, or bore but it is not
likely to corrupt. There is no cruelty, violence, or perversion;
deviations are realistically assessed; personality is taken
seriously. The story is sometimes sentimental, sometimes crude,
sometimes faintly absurd.

We do not consider that simple lack of high quality com-
bined with the erotic nature of the subject requires us in
terms of the Act to ban this book. We think it is in the
