Taylor's Mistake Harbour Order 1971

At the Government House at Wellington this 8th day of June 1971.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
Pursuant to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and, in relation to clause 3 of this order, on the request of Christchurch City Council, hereby makes the following order.
ORDER
- (1) This order may be cited as the Taylor's Mistake Harbour Order 1971.
(2) This order shall come into force on the date of its publication in the Gazette.
(3) The Taylor's Mistake Harbour Order 1970* is hereby revoked. - In this order—
"The Act" means the Harbours Act 1950;
"The Council" means the Christchurch City Council;
"Foreshore" means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the ebb and flow of the tide at ordinary spring tides;
"Minister" means the Minister of Marine and Fisheries and includes any officer, person, or authority acting by or under the direction or authority of the Minister. - There is hereby granted to the council for a period of 21 years from the commencement of this order, subject to the provisions of section 165 of the Act and to the conditions specified in the Second Schedule to this order, the control of the foreshore described in the First Schedule to this order.
SCHEDULES
FIRST SCHEDULE—FORESHORE
All that area of foreshore at Taylor's Mistake westward of a right line commencing at a point on high-water mark near Moki Point in line with the north-eastern corner of section 48, D.P. 8071, and the south-western corner of section 51, D.P. 8071, and running in a southerly direction across the bay to high-water mark on the southern shore.
SECOND SCHEDULE—CONDITIONS
- Her Majesty or the Governor-General and all officers in the Government service acting in the execution of their duty shall, at all times, have free ingress, passage, and egress into, over, and out of the said foreshore and waters described in the First Schedule to this order, without payment.
- Nothing herein contained shall authorise the council to do, or cause to be done, anything repugnant to, or inconsistent with, any law relating to the Customs, or with any regulation of the Minister of Customs, or with any provision of the Harbours Act 1950 or its amendments, or any regulations made thereunder that are, or may hereafter be, in force.
- The rights, powers, and privileges conferred by this Order in Council shall not apply to those portions of the foreshore required for securing the shore ends of any telegraph cables that are at present, or may be at any time, laid down within the area of foreshore described in the First Schedule to this order.
- The council may enclose any part or parts of the foreshore described in the First Schedule to this order for the purpose of holding athletic sports or games and may, by bylaw, fix a charge for admission to such enclosed part or parts:
Provided that the total number of days on which such enclosures are made shall not exceed six in any one year. - Nothing herein contained shall authorise the council to remove, or cause to be removed, any stone, sand, shingle, or shells without the consent of the Minister being first obtained.
- The said rights, powers, and privileges may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the council 6 calendar months' notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at, or posted to, the last-known address of the council in New Zealand.

Pursuant to section 2 (1) (f) of the National Art Gallery and Dominion Museum Amendment Act 1936, the Governor-General hereby appoints the following to be members of the Board of Trustees of the National Art Gallery and Dominion Museum:
Harry Edgar Duff Daysh, C.B.E., J.P., for a further term of 3 years expiring on 25 July 1974;
William Tuakana Ngata, for a further term of 3 years expiring on 30 June 1974, as the representative of the Maori race;
Reginald James Waghorn, M.A., J.P., for a further term of 3 years expiring on 30 June 1974, as one of the representatives of the New Zealand Academy of Fine Arts; and Maurice Noel Manthel, for a term of 3 years expiring on 30 June 1974.

Pursuant to the National Roads Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby appoints John Newton Leon Searle, assistant commissioner of works, to be a member of the National Roads Board in place of Brian Creagh Magill, assistant commissioner of works, retired.

Appointments, Promotions, Transfers, and Retirements of Officers of the Royal New Zealand Navy
Pursuant to the Navy Act 1954, His Excellency the Governor-General has approved the following appointments, promotions, transfers, and retirements of officers of the Royal New Zealand Navy:
Lieutenant Commander F. W. Ralph, M.B.E., is transferred to the Retired List and is re-employed on the Active List, to date 5 September 1970.
Lieutenant Commander G. M. Walton is transferred to the Retired List and is re-employed on the Active List, to date 14 March 1971.
Lieutenant Commander P. K. Laker is granted the acting rank of Commander, to date 14 June 1971.
Acting Commander P. K. Laker is promoted to the rank of Commander, to date 2 July 1971, with seniority of 31 December 1970.
Lieutenant Commander J. S. Day, M.B.E., is transferred to the Retired List, to date 16 May 1971.
Surgeon Lieutenant Commander H. C. Prain, appointment terminated, to date 19 January 1971.
Temporary Lieutenant Commander R. F. Hulford is promoted to the rank of Lieutenant Commander, to date 1 May 1971.
Lieutenant R. Goddard, M.B.E., is granted the temporary rank of Lieutenant Commander, to date 17 May 1971.
Leonard Douglas Light is appointed to the RNZN as Instructor Lieutenant with seniority of 3 May 1966, for a period terminating 2 May 1976, to date 3 May 1971.
Lieutenant L. H. Hall, is transferred to the Emergency List for a period of 5 years terminating 7 May 1976, to date 8 May 1971.
John Keith Carter, NZ 16757, MEA 1, is promoted to the rank of Sub-Lieutenant (on probation) with seniority of 31 May 1971, for a period terminating 30 May 1983, to date 31 May 1971.
