No. 286

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the book The X Y Z of Love by Inge and Sten Hegeler. Published by McGibbon and Kee Ltd., London.

The Tribunal has considered The X Y Z of Love by Inge and Sten Hegeler. There was no appearance of the applicant. Mr P. J. Downey appeared as counsel for an importer, not the publishers' agent, who had had copies seized by Customs.

DECISION OF THE TRIBUNAL

Mr Downey stated that the book had been on sale for some time. He claimed that the approach of the authors was basically factual, advisory, and seriously intended; that the lightness of touch with which the theme was handled was not inappropriate, and that the book was a useful supplement to other acceptable works in this field by the same authors. The cover was not objectionable.

All of this argument we readily accept and we consider the book a valuable one for adult inquirers. It is, however, very explicit about some of the more sophisticated love-making practices and we do not consider it to be in the public interest that young people should be introduced to these too easily.

The Tribunal classify the book as indecent in the hands of persons under the age of 18 years.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by Murdoch Riley, manager, of Wellington, for decisions in respect of My Carnal Confession by Gerty Agoston, published by Universal Tandem Publishing Co. Ltd., London; The Innocent One by Lisa March, published by Universal Tandem Publishing Co. Ltd., London; Cruel Venus by Victor Rogano, published by Canova Press; and Sex Watchers by Sterling Harkins, published by Ben's Books Ltd., London.

Mr P. J. Downey appeared on behalf of the applicant and made submissions.

DECISIONS OF THE TRIBUNAL

My Carnal Confession

This book by Gerty Agoston was compared by Mr Downey, counsel for the publishers' agent, with an earlier book by the same author which the Tribunal considered in decision No. 183, and proceeded to classify as indecent in the hands of persons under the age of 17 years.

Mr Downey submitted that the present book before the Tribunal was of comparable quality. The Tribunal in that earlier decision described that book as "quite well written" and said that parts were "quite amusing". My Carnal Confession does not merit such comments. It is a pretentiously written and tedious story about a couple obsessed with sexual pleasure. The claim made on the cover, "Perhaps the most explicit sexual confession ever made by a woman" is, fortunately, not what the Tribunal has to decide. What it does decide is that in this novel sex is presented in debased rather than in honest terms, and that this is injurious to the public good.

The Tribunal classifies the book as indecent.

The Innocent One

This book is claimed to be the translated memoirs of a Swedish servant girl working for an American family and is offered as a literary discovery, similar to other authentic
