Declaring Land Taken for Better Utilisation in Block X,
Christchurch Survey District, Paparua County

Pursuant to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the Schedule hereto is hereby taken for better utilisation from and after the 3rd day of May 1971.

Declaring Land and a Drainage Easement and Right of Way Over Land Taken for Waterworks in Block VII, Ruakaka Survey District, Whangarei County

Pursuant to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for waterworks and shall vest in the chairman, councillors, and inhabitants of the County of Whangarei from and after the 3rd day of May 1971; and that a drainage easement is hereby taken for waterworks purposes over the land described in the Second Schedule hereto from and after the 3rd day of May 1971, vesting in the chairman, councillors, and inhabitants of the County of Whangarei, the full and free right, liberty, and licence for all times to carry and convey into pipes and/or concrete conduits through and under the land described in the Second Schedule hereto all stormwater, surface water, and waste water which shall from time to time be upon or shall collect on the land described in the First Schedule hereto, and to discharge the same beyond the land described in the Second Schedule hereto and for such purposes the Council shall have the right from time to time to dig up to any depth and again fill in the soil and to alter, repair, and maintain the pipes and/or concrete conduits and to lay down, construct, and erect and make in, through, or under the land described in the First Schedule hereto pipes and/or concrete conduits of such size as the Council shall think fit for carrying and conveying the said water with such man-holes, valves, and surface boxes as the grantee shall think fit, and from time to time to inspect, maintain, cleanse, repair, extend, remove, and enlarge such pipes and/or concrete conduits, man-holes, valves, and surface boxes, and from time to time to repair and maintain all works in connection therewith, and also full power and authority for the Council, its surveyors, engineers, workmen, agents, and servants, with or without horses, carts, and other vehicles and machinery of all descriptions from time to time and at all times to enter and remain for any of the purposes aforesaid upon the land described in the Second Schedule hereto as shall be necessary for such purposes and generally to do and perform such acts and things in or upon the land described in the Second Schedule hereto as may be necessary or proper for or in relation to any of the purposes aforesaid, such easement to be held appurtenant to the land described in the First Schedule, and that an easement of right of way is hereby taken for waterworks purposes over the land described in the Third Schedule hereto, from and after the 3rd day of May 1971, vesting in the chairman, councillors, and inhabitants of the County of Whangarei, the full, free, and perpetual right of way, ingress, egress, and regress for the Council and its successors and assigns and its and their servants, agents, workmen, and visitors and all persons having business with it or them with or without animals, implements, and vehicles of every description, loaded or unloaded, by night as well as by day, in, over, and upon the land described in the Third Schedule hereto in common with the owner for the purpose of giving access to and from the land described in the First Schedule hereto, such easement to be held appurtenant to the land described in the First Schedule hereto.

ALL that piece of land containing 13.2 perches situated in Block VII, Ruakaka Survey District, North Auckland R.D., being part Lot 1, D.P. 48035; coloured sepia on plan.

THIRD SCHEDULE
NORTH AUCKLAND LAND DISTRICT
ALL that piece of land containing 1 rood 17 perches situated in Block VII, Ruakaka Survey District, North Auckland R.D., being part Lot 2, D.P. 31401; coloured yellow on plan.
