Decision of the Indecent Publications Tribunal


IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the book A Psychiatrist Discusses 21 Abnormal Sex Cases by Dr Michael M. Gilbert with Robert S. Tralins. Published by Paperback Library Inc., New York. Paperback 95c (U.S.).

There was no appearance of the applicant nor of the publisher’s representative in New Zealand. Accordingly no submissions were made to the Tribunal.

DECISION OF THE TRIBUNAL

THIS low-priced paperback is described on the cover as being “written by a distinguished psychiatrist”, but the title-page declares it to be “by Dr Michael M. Gilbert with Robert S. Tralins”. No professional standing is claimed for the latter, and it appears that the original studies of the professional psychiatrist have been given a popular treatment by a professional publisher’s writer.

As with some other works of comparable presentation and origins which the Tribunal has considered in earlier decisions, it is questionable whether the claim made for this book as a serious study of its subject can be accepted. The main part of the book is taken up with the case histories of the abnormalities, which are presented in unhurried detail, and the emphasis of the book as a whole falls on these rather than on the analysis and discussion of the abnormalities. The case histories are presented separately from the very brief diagnoses of them and this serves to increase the emphasis on the former. The book may be of some interest to those adult readers who are capable of interpreting the case histories and they should have access to it. Taking into consideration the matters referred to in section 11 of the Act the Tribunal is of the view that it is neither necessary nor desirable that this particular material should be available to younger people in this form.

The Tribunal classifies this book as indecent in the hands of persons under 18 years of age.

There was no appearance of the applicant nor of the publisher’s representative in New Zealand. Accordingly no submissions were made to the Tribunal.

DECISION OF THE TRIBUNAL

THE book is concerned with the sailor’s sexual adventures as he moves round the world in a variety of ships. Most are brief encounters related in a frankly erotic but not unpleasant way. The book has little literary or social worth, but cannot be regarded as likely to harm or upset adult readers. Because of its moral tone and the detail in which the sexual adventures are described we feel that it could well disturb the views and attitudes of young people.

The Tribunal classifies the book as indecent in the hands of persons under the age of 18 years.
