THE CHARITABLE TRUSTS ACT 1957
NOTICE OF APPLICATION FOR APPROVAL OF SCHEME UNDER PART III
WHEREAS one Adeline Renwick, deceased, by her will and codicil declared certain trusts which are now administered and managed by the Public Trustee under the title of the Renwick Cottages Trust, subject to and in conformity with the provisions of a scheme under Part III of the Religious, Charitable, and Educational Trusts Act 1908, approved by a Judge of the Supreme Court on the 22nd day of September 1954:
And whereas pursuant to that scheme six small residential cottages situate at the corner of Wellington and Examiner Streets, Nelson, and known as Renwick Cottages are administered for such persons of either sex as shall be selected in the manner mentioned and on the terms set forth in the said scheme:
And whereas in order satisfactorily to continue administration of the said cottages under the said scheme, substantial expenditure for the renovation or improvement of the said cottages would now be necessary and desirable, but in the opinion of the Public Trustee such expenditure because of the age of the said cottages could not be justified:
And whereas the Public Trustee considers that it would be desirable for the said cottages to be demolished and replaced by new buildings in which aged or needy persons may live:
And whereas the Public Trustee is desirous that the trust premises on which the said cottages are built should be dealt with subject to Part III of the Charitable Trusts Act 1957, in accordance with the provisions of a scheme filed in the Supreme Court at Nelson:
And whereas the Nelson City Council has indicated that it is prepared to carry out the provisions of the said scheme if it is duly approved:
Now notice is hereby given that the Public Trustee has, with the consent of the Nelson City Council, applied to the Supreme Court at Nelson for approval to transfer the trust premises to the Mayor, Councillors, and Citizens of the City of Nelson, a body corporate under the Municipal Corporations Act 1954 (hereinafter called “the Corporation”), to hold the trust premises upon trust to provide thereon within 3 years of transfer to the Corporation not less than six houses (as defined in Part XXIV of the Municipal Corporations Act 1954) for occupation by aged and needy persons, such houses to be administered in accordance with the Government’s pensioner housing policy as notified to local authorities from time to time.
Copies of the application, the scheme, and the report of the Attorney-General thereon may be inspected free of charge at the offices of the Registrar, Supreme Court, Nelson, the District Public Trustee, Nelson, and the Town Clerk, Nelson.
The date proposed for the hearing of the application is Tuesday, the 15th day of June 1971.
Any person desiring to oppose the scheme is hereby required to give written notice of his intention to do so to the Registrar of the Supreme Court, Nelson, and to the District Public Trustee for Nelson, and to the Town Clerk, Nelson, and the Attorney-General, Wellington, not less than 7 clear days before that date.
R. D. SYMNS,
Solicitor to the Public Trust Office,
