Notice of Intention to Take Land in Block IX, Maramarua Survey District, Waikato County, for Soil Conservation and River Control Purposes

Notice is hereby given that it is proposed, under the provisions of the Public Works Act 1928, to execute a certain public work, namely, the construction of the Lower Waikato - Waipa River control scheme, section B; and, for the purposes of that public work, the land described in the Schedule hereto is required to be taken. And, notice is hereby further given that the plan of the land so required to be taken is deposited in the post office at Te Kauwhata and is there open for inspection; that all persons affected by the execution of the said public work or by the taking of the said land should, if they have any objections to the execution of the said public work or to the taking of the said land, not being objections to the amount or payment of compensation, set forth the same, in writing, and send the written objection, within 40 days of the first publication of this notice, to the Minister of Works at Wellington; and that, if any objection is made in accordance with this notice, a public hearing of the objection will be held, unless the objector otherwise requires, and each objector will be advised of the time and place of the hearing.

Agreement for Grant of Right of Way in Favour of Douglas Julian Carter over Land in Block X, Hapuakohe Survey District, Taken for Soil Conservation and River Control Purposes, Assented to

Whereas, by a notice dated 3 September 1969 and published in New Zealand Gazette, 2 October 1969, No. 60, p. 1901, all those pieces of land containing together 26 acres 1 rood 17.6 perches, situated in Block X, Hapuakohe Survey District, being parts Lot 7, D.P. 34443, were taken for soil conservation and river control purposes;

And whereas Douglas Julian Carter was entitled to compensation in respect of the taking of the said land;

And whereas the Minister of Works has agreed to grant to the said Douglas Julian Carter a right of way over all that piece of land containing 2 roods 26.9 perches situated in Block X, Hapuakohe Survey District, being part Lot 7, D.P. 34443; shown coloured yellow on plan M.O.W. 21582 (S.O. 44048);

And whereas the said Douglas Julian Carter has agreed to accept such grant of right of way in part satisfaction of the said compensation;

Now, therefore, the Minister of Works hereby gives notice, pursuant to section 97 of the Public Works Act 1928, that he assents to the agreement hereinbefore referred to.
