Merger of the Electric Supply Districts of the Taranaki Electric Power Board and the Stratford Borough Council

PURSUANT to the Electricity Distribution Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

O R D E R

  1. MERGER OF DISTRICT

The licensed area of supply of the Stratford Borough Council, as defined in the Stratford Borough Council Electric Lines Licence, dated 19 July 1967 and published in the New Zealand Gazette on 27 July 1967, at p. 1266, is hereby included and merged in the Taranaki Electric Power Board’s Electric Power District. For the purposes of the Electric Power Boards Act 1925, this merger shall be deemed also to have been effected under that Act.

  1. RIGHTS AND OBLIGATIONS OF SUPPLY AUTHORITY

Pursuant to section 34 of the Electricity Distribution Commission Act 1967, the Taranaki Electric Power Board shall exercise all rights and undertake all obligations previously exercised by the Stratford Borough Council in carrying on its electricity undertaking.

  1. REPRESENTATION

As from the date of merger, the Borough of Stratford shall become a constituent district of the Taranaki Electric Power Board, which from that date shall consist of 11 members. The Taranaki Electric Power District Representation Order 1965, published in the New Zealand Gazette of 14 April 1965, at p. 521, is hereby amended by the addition of the following to the Schedule thereto:

The first representatives of the Borough of Stratford on the Taranaki Electric Power Board shall be appointed by the Stratford Borough Council and shall hold office until the next triennial local body election. All subsequent representatives of the borough shall be elected by the electors of the Borough of Stratford.

  1. PURCHASE PRICE

The Taranaki Electric Power Board shall pay to the Stratford Borough Council the sum of $363,000 for the purchase of the Council’s electricity undertaking, property, and assets, as defined in the First Schedule attached hereto; provided that the said amount of $363,000 shall be increased by the amount of any capital expenditure put into the said electricity undertaking, property, and assets between 1 April 1969 and the date of completion of this sale and purchase.

  1. DISPOSITION OF ASSETS AND LIABILITIES

As from the date of completion, the Taranaki Electric Power Board shall take over from the Stratford Borough Council the electricity undertaking, property, and assets described in the First Schedule. All liabilities incurred by the Stratford Borough Council up to the date of completion shall remain liabilities of the Council only.

  1. TARIFFS

As from the date of completion, the charges payable by consumers (including the Council) of electrical power in the district of Stratford Borough shall be the charges payable by consumers in the power board’s district.

  1. STAFF

The Taranaki Electric Power Board shall continue to employ, as required by the Local Authorities (Employment Protection) Act 1963, all those persons employed in the Stratford Borough Council’s electricity undertaking who elect to continue in that employment.

  1. DATE OF COMPLETION

The date of completion of the above sale and purchase shall be 4 February 1970, and the merger shall come into force on that date. Possession of all property included in the sale shall be taken on that date.

SCHEDULE

DESCRIPTION of the electricity undertaking, property, and assets of the Stratford Borough Council to be purchased by the Taranaki Electric Power Board:

The whole of the Council’s electricity undertaking for the supply of electricity to the citizens of the Borough of Stratford, together with all the property and assets, whether real or personal, and all stock, chattels, and things, and all rights of all kinds belonging to or held or used by the Council in connection with the said electricity undertaking.

Excluding, however, the following property and assets, which shall remain the property of the Council, namely:

  1. The Stratford Borough Council’s Electricity Department’s Depreciation Fund.

  2. All moneys standing to the credit of any bank account of the Stratford Borough Electricity Department at the date of completion and all cash in hand held by the Stratford Borough Council at that date.

  3. All debts owing to the Council in respect of its said electricity undertaking at the date of completion.

  4. Certain electrical assets situated in the properties known as No. 60 Miranda Street, No. 38 Orlando Street, and No. 1 Elsinore Street, Stratford, and shown in the Council’s Electricity Department balance sheet as at 31 March 1969, valued at $100.48, $215.85, and $238.69 respectively.

  5. All store buildings, as shown in the Council’s Electricity Department balance sheet as at 31 March 1969, valued at $4,357.03.

  6. All park lighting and aerodrome lighting, as shown in the Council’s Electricity Department balance sheet as at 31 March 1969, valued at $6,031.84 and $617.94 respectively.

  7. All office furniture and equipment, as shown in the Council’s Electricity Department balance sheet as at 31 March 1969, valued at $8,219.43.

  8. The item described in the Council’s Electricity Department balance sheet as at 31 March 1969 as “Consumers’ Premises” and valued therein at $12,470.31.

Exempting Certain Maori Land from Rates

ORDER IN COUNCIL

At the Government Buildings at Wellington this 2nd day of February 1970

Present:

THE RIGHT HON. KEITH HOLYOAKE, C.H., PRESIDING IN COUNCIL

PURSUANT to section 149 (1) of the Rating Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby exempts the Maori freehold land described in the Schedule hereto from payment of all rates made or levied by any local authority under the provisions of the Rating Act 1967 for the period from the 1st day of April 1962 to the 31st day of March 1971 inclusive; and, pursuant to section 149 (2) of the Rating Act 1967, hereby releases such land from payment of the whole of the rates made and levied in respect of the part of such period which is before the commencement of this Order in Council.
