Merger of the Electric Supply Districts of the Wanganui-Rangitikei Electric Power Board and the Taihape Borough Council

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Electricity Distribution Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

MERGER OF DISTRICT

  1. The licensed area of supply of the Taihape Borough Council, as defined in the Taihape Borough Council Electric Lines Licence dated 3 August 1953 and published in the Gazette on 13 August 1953, at p. 1309, is hereby included and merged in the Wanganui-Rangitikei Electric Power Board’s Electric Power District. For the purposes of the Electric Power Boards Act 1925, this merger shall be deemed also to have been effected under that Act.

RIGHTS AND OBLIGATIONS OF SUPPLY AUTHORITY

  1. Pursuant to section 34 of the Electricity Distribution Commission Act 1967, the Wanganui-Rangitikei Electric Power Board shall exercise all rights and undertake all obligations previously exercised by the Taihape Borough Council in carrying on its electricity undertaking.

REPRESENTATION

  1. The Borough of Taihape shall remain a constituent district of the Wanganui-Rangitikei Electric Power Board with a representation of one member as defined in the Wanganui-Rangitikei Electric Power District Representation Order 1965, dated 1 September 1965 and published in the Gazette on 9 September 1965 at p. 1499.

The present representative of the Borough of Taihape on the Board shall hold office until the next triennial local body election. All subsequent representatives of the Borough shall be elected by the electors of the Borough of Taihape.

PURCHASE PRICE

  1. The Wanganui-Rangitikei Electric Power Board shall pay to the Taihape Borough Council the sum of $200,000 for the fixed assets of the Council’s electricity undertaking, plus additional sums to be agreed upon for stocks and materials, the completion of certain underground reticulation, and for consultant’s fees incurred by the Borough as specified in the agreement made between the Board and the Council.

DISPOSITION OF ASSETS

  1. As from the date of completion of this sale and purchase the Wanganui-Rangitikei Electric Power Board shall take over from the Taihape Borough Council the electricity undertaking, property, and assets described in the Agreement.

TARIFFS

  1. As from 1 October 1970, the charges payable by consumers of electric power in the Borough of Taihape shall be the same as those paid by consumers in the Wanganui-Rangitikei Electric Power Board’s district.

STAFF

  1. The Wanganui-Rangitikei Electric Power Board shall continue to employ, as required by the Local Authorities (Employment Protection) Act 1963, the four members of the staff previously employed in the Taihape Borough Council’s electricity undertaking.

DATE OF COMPLETION

  1. The date of completion of the above sale and purchase shall be 30 September 1970, and possession of all property included in the sale shall be taken on that date.

The merger shall come into force on 1 October 1970.

Authorising the Otago Harbour Board to Reclaim Endowment Land at Port Chalmers

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 175 (3) of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Otago Harbour Board to reclaim from the sea at Port Chalmers an area of 9 acres 3 roods 8 perches, more or less, of endowment land as shown edged red on plan M.D. 13958 and deposited in the office of the Marine Department at Wellington.

Extending the Time Within Which the Commission of Inquiry into Housing May Report

HILTON JAMES BARRETT, Esquire, of Auckland;
ALISTER MURRAY LINTON, Esquire, C.B.E., of Rotorua;
IAN BRAMPTON REYNOLDS, Esquire, of Auckland;
JOHN DICK WALKER, Esquire, of Wellington; and
PHILIP MAXWELL MACSHANE, Esquire, of Christchurch:

GREETING:

WHEREAS, by Order in Council made on the 20th day of April 1970*, you the said Robin Brunskill Cooke, Hilton James Barrett, Alister Murray Linton, Ian Brampton Reynolds, and John Dick Walker were appointed to be a Commission to inquire into and report upon certain matters relating to housing:

AND WHEREAS, by Order in Council made on the 18th day of May 1970†, you the said Philip Maxwell MacShane were appointed to be an additional member of the said Commission:

AND WHEREAS the said Commission was by the first-mentioned Order in Council required to submit its report not later than the 31st day of October 1970:

And whereas it is expedient that the time for so reporting should be extended as hereinafter provided:

Now, therefore, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, acting pursuant to the Commissions of Inquiry Act 1908, and by and with the advice and consent of the Executive Council, hereby extend until the 30th day of April 1971, the time within which you are so required to report, without prejudice to the continuation of the liberty conferred upon you by the said first-mentioned Order in Council to report your proceedings and recommendations from time to time if you should judge it expedient so to do, and do hereby confirm the said Orders in Council and the Commission thereby constituted, save as modified by these presents.

Given in Executive Council under the hand of His Excellency the Governor-General, this 5th day of October 1970.

to be a Conciliation Commissioner under and for the purposes of the said Act; appointment to date from the 1st day of October 1970.
