CHARITABLE TRUSTS ACT 1957
In the Supreme Court of New Zealand
Wellington District
(Palmerston North Registry)
IN THE MATTER of the Charitable Trusts Act 1957, and IN THE MATTER of an application by the PALMERSTON NORTH HOSPITAL BOARD for approval of a scheme varying the disposition of the property and income of the JANE EMILY BROWN ESTATE Charitable Trust:
NOTICE is hereby given that the PALMERSTON NORTH HOSPITAL BOARD as trustee of a trust fund created pursuant to the will of JANE EMILY BROWN, deceased, who died at Auckland, on the 4th day of March 1907, will move in the Supreme Court at Palmerston North, on Friday, the 11th day of September 1970, at 10 a.m., for an order approving a scheme varying the disposition of the said fund. Under the will the deceased bequeathed the residue of her estate upon trust for the benefit of the Cottage Hospital for Consumptives at Otaki, to be applied by the trustee in such a manner that it may be a lasting momento of her friend Mrs Emily McWilliam and of her work in connection with the said institution. The said scheme provides that the trust be varied so that the annual income from the fund will be applied for the sole benefit of tuberculosis patients at the Palmerston North Hospital as a lasting memorial to Mrs McWilliam, by establishing and maintaining an up-to-date library, occupational therapy services and equipment, and equipment and amenities for recreation, sport, and entertainment. A copy of the scheme may be inspected at the Supreme Court office, Palmerston North. Any person desiring to oppose the scheme must give written notice of his intention to do so to the Registrar of the Supreme Court at Palmerston North, to the Secretary of the Palmerston North Hospital Board, and to the Attorney-General not less than seven (7) days before the said date of hearing.
The Palmerston North Hospital Board by its Solicitor:
J. R. CALLANDER.
