- Special provisions affecting the said area—In respect of the part of the Marlborough Catchment District that comprises the said area the following provisions shall apply:
(a) The provisions of Part V of the Soil Conservation and Rivers Control Act 1941 shall not apply:
Provided that they shall apply to the extent of any agreement to operate the whole or any part of the said Part V made, with the approval of the National Water and Soil Conservation Authority, between the Marlborough Catchment Board, and any territorial local authority having jurisdiction in the said area in respect of the whole or any part of the said area.
(b) The provisions of section 126 of the Soil Conservation and Rivers Control Act 1941 shall not apply:
Provided that they shall apply to the extent of any agreement to operate the provisions of that section made, with the approval of the National Water and Soil Conservation Authority, between the Marlborough Catchment Board and any territorial local authority having jurisdiction in the said area in respect of the whole or any part of the district of that local authority.
(c) The provisions of subsection (1) of section 20 of the Water and Soil Conservation Act 1967 shall be restricted to conform with the provisions of paragraphs (a) to (d) of this clause.
(d) Each territorial local authority having jurisdiction in the said area shall make by way of an annual contribution to the Marlborough Catchment Board towards the administration costs incurred by the said Marlborough Catchment Board in carrying out its functions under the Water and Soil Conservation Act 1967 such sum or rate as may from time to time be fixed by any Act or Regulation in that behalf. Unless and until any such sum or rate has been so fixed the amount to be so paid shall be agreed upon between the territorial local authority and the Marlborough Catchment Board and in the event of failure of the territorial local authority and the Marlborough Catchment Board to agree on any such sum, then such sum as may be determined by the National Water and Soil Conservation Authority. In addition the Marlborough Catchment Board may levy any of the said territorial local authorities having jurisdiction over the said area for the cost of any work undertaken or proposed to be undertaken in the district of that local authority for the purposes of the Water and Soil Conservation Act 1967 as hereinbefore restricted and the cost of such work may be increased by a percentage to provide for administration and other expenses in respect of the work as more particularly described in subsection (2) of section 84 of the Soil Conservation and Rivers Control Act 1941 which for this purpose shall be read as if the reference in that subsection to that Act were references to the Water and Soil Conservation Act 1967, such percentage being from time to time determined by agreement between the said Catchment Board and the said local authority:
Provided that, where an agreement as referred to in the foregoing subparagraph (a) and subparagraph (b) of this clause is entered into with any territorial local authority the provisions of this paragraph shall cease to operate and shall be modified in respect of the district of that territorial local authority to ensure compliance with the terms of such agreement.

Firstly, all that area of land in the Marlborough and Nelson Land Districts, County of Marlborough, and Borough of Picton; containing 345,000 acres, more or less; contained within a line commencing at North Castor Peak in Block VIII, Whangamoa Survey District, and proceeding northerly along a right line to the sea coast at Pukerau Point in Block IV, Whangamoa Survey District; thence due north to the parallel of latitude 40° 30′ south; thence due east to meridian of longitude 174° 30′ east, thence due south to a point due east of the southernmost corner of Section 4, Block XIV, Arapawa Survey District; thence due west to the sea coast of Island Bay in Block XIV, aforesaid; thence generally southerly along the sea coast to its intersection with the north-eastern boundary of the Marlborough Harbour Board Endowment in Block IV, Cloudy Bay Survey District; thence north-westerly and westerly along that north-eastern boundary and the northern boundary of the said Endowment to the north-western corner of that Endowment; thence north-westerly along a right line to Sub. Trig. 41 in Block IV, aforesaid; thence north-westerly along a right line to Sub. Trig. IX in Block IV, aforesaid; thence northerly along a right line to the easternmost corner of Section 8 Block IV, aforesaid;
thence north-westerly along a right line to Trig. Station X, Mount Robertson in Block XVI, Linkwater Survey District; thence north-westerly along a right line to the intersection of the north-eastern boundary of Section 6, Block XVI, aforesaid, with the northern boundary of State Forest; reserved by Gazette 1881, page 959; thence north-westerly generally along the north-eastern boundaries of that Section 6 and Run 65 to the eastern boundary of Section 4, Block XVI, aforesaid; thence generally northerly along the eastern boundaries of that Section 4, Section 3, Block XVI, aforesaid, and Section 22, Block XII, Linkwater S.D. to Trig. Station A in Block XII, aforesaid; thence north-westerly along a right line on a bearing of 312° 40′ for distance of 11680 links to the southernmost corner of Section 5, Block XI, Linkwater S.D.; thence generally westerly along the northern boundaries of Sections 22 and 10, Block XI, aforesaid, to the north-eastern boundary of Section 14, Block XI, aforesaid; thence generally north-westerly along the north-eastern boundaries of Sections 14, and 2 of 3 Block XI, aforesaid, to a point due south of a point on the mean high water mark 30 chains east of Grove Wharf; thence due north to the said mean high-water mark; thence generally westerly, northerly, and easterly along the said mean high-water mark to Iwituaroa Point in Block VII, Linkwater Survey District; thence generally northerly along the water shed between Anikiwa and Umungata Bay, through Trig. Station L to its junction on the northern boundary of Section 4, Block VII, aforesaid, with the water shed between Mahau Sound and Linkwater; thence generally south-westerly along that water shed to Trig. Station OO Mount Oliver; thence generally westerly along the said water shed to Trig. Station D, Mount Cawte and continuing generally westerly along the northern boundary of Part Section 2, Block IX, Linkwater Survey District and its production to the mean high-water mark of Mahakipawa Arm, Pelorus Sound; thence generally easterly, westerly, and north-westerly along the said mean high-water mark to Cullens Point; in Block XII, Wakamarina S.D.; thence generally southerly along the mean high-water mark of Havelock Harbour to its intersection with the northern side of the Picton-Havelock Road; thence westerly generally along the northern side of that road to its intersection with the mean high-water mark of Havelock Harbour; thence generally northerly and westerly along that mean high-water mark to the mouth of the Pelorus River; thence northerly across the mouth of the Pelorus River to and northerly and easterly along the mean high-water mark of Havelock Harbour to a point in line with the eastern boundary of Section 14, Block VIII, Wakamarina Survey District; thence generally northerly to and along the eastern boundaries of Sections 14, 50, 49, and 6, Block VIII, aforesaid, to the north-eastern boundary of that Section 6; thence generally north-westerly along the north-eastern boundaries of the said Section 6 and Part Section 1 of 1 Block VIII, aforesaid, to the northernmost corner of the said Part Section 1 of 1; thence north-westerly along a right line to the junction of the summit of the water shed between the Opouri River and the Kaiuma Stream and the boundary between Blocks III, and VII, Wakamarina Survey District; thence generally northerly and north-westerly along the summit of that water shed and the summit of the Opouri Range to Trig. Station B, Editor Hill, in Block VI, Tennyson Survey District; thence generally westerly along the summit of the northern water sheds of the Tunakino and Renga Rivers to the summit of the range between North Castor Peak and South Castor Peak; thence generally northerly along the summit of that range to the point of commencement; excluding therefrom all those areas below mean high-water mark of the sea near Marlborough Sounds, Croisilles and D’Urville Island extending from Pukerau Point in Block IV Whangamoa Survey District to Island Bay in Block XIV, Arapawa District.
Secondly, all that area in the Marlborough Land District, Counties of Marlborough and Awatere, containing 495,500 acres more or less, bounded by a line commencing at the north-eastern corner of Section 163, Wakefield Downs Registration District, situated in Block III, Clifford Bay Survey District; thence proceeding generally north-westerly along the north-eastern boundary of the said Section 163 to its intersection with the sea coast; thence generally southerly along the sea coast to a point in line with a right line between the southernmost corner of Part Section 2, Block X, Cape Campbell Survey District, and Trig. Station Single Hill; thence north-westerly to and along that right line to the said southernmost corner of Part Section 2; thence north-westerly and westerly along the north-eastern and northern boundaries of Part Section 1, Block X, aforesaid, to Trig. Station House top on the boundary between Blocks VIII and X, Cape Campbell Survey District; thence generally northerly, westerly, and southerly along the summit of the water shed between the Flaxbourne and Waima Rivers to Trig. Station O, Blue Mountain, on the boundary between Blocks XII and XIII, Blue Mountain Survey District; thence generally south-westerly along the summit of the water shed between the Medway and Waima Rivers to Trig.
