thereof payable in respect of the loans secured by those special rates and the Papatoetoe City Council hereby further resolves that the consolidated special rate shall be payable in one sum on the 1st day of August in each year, at the City Council Office, St. George Street, Papatoetoe, to George Henry Mills Green, City Treasurer, or at such other place or to such other person for the time being authorised by the council.

THE CHARITABLE TRUSTS ACT

NOTICE OF APPLICATION

IN THE MATTER of the Charitable Trusts Act 1957, and IN THE MATTER of a certain deed of trust dated 25 August 1948, and made between Enid Nancy Bowker, of Christchurch, spinster, of the one part and the Presbyterian Church Property Trustees of the other part:

NOTICE is hereby given pursuant to section 36 of The Charitable Trusts Act 1957, that the Presbyterian Church Property Trustees as trustees under the said deed of Trust, dated the 25th day of August 1948, have applied to the Supreme Court of New Zealand, at Christchurch, for approval of a scheme prepared in that behalf as required by section 34 of the Charitable Trusts Act 1957, varying the trusts upon which the trustees hold all that piece of land situated in Memorial Avenue, Christchurch, containing one acre one rood and thirty-one decimal six perches (1A. 1R. 31.6P.), being Lot 1, Deposited Plan 14686, and being also part Rural Section 117, and being all the land in certificate of title, Volume 527, folio 166, Canterbury Registry.

PARTICULARS of the scheme are as follows:

1. That, the Trustees be no longer bound to hold the above-described land for a church and manse, such church to have been called the Burnside Church.

2. That, the trustees be given power to sell the above-described land, and to divide the net proceeds of sale into three equal parts, and to pay one of each such parts:

(a) To the board of managers of the St. Stephen’s parish, to be used for the development of additional church buildings;

(b) To the board of managers of the St. Mark’s parish, to be used for the development of additional church buildings in the Avonhead section of the parish;

(c) To the board of managers of the St. Mark’s parish to be used for the development of additional church buildings in the Westburn section of the parish.

Pursuant to Section 35 of the Charitable Trusts Act 1957, the application, scheme, and report of the Attorney-General thereon have been filed and are open for inspection, without any fee or charge, at the Registry Office of the Supreme Court, Christchurch.

The date proposed for the hearing of the application for approval is the 7th day of August 1970, at 10 a.m.

Any person desiring to oppose the scheme is required to give written notice of his intention to do so, to the Registrar of the Supreme Court at Christchurch, and to the trustees, whose address for service is at the offices of its solicitors, Messrs Anthony, Polson, and Robertson, 110 Armagh Street, Christchurch, and to the Attorney-General not less than 7 clear days before the date proposed for the hearing of the application.
