The Morven-Glenavy Extension Irrigation District Order 1970

RICHARD WILD, Administrator of the Government ORDER IN COUNCIL At the Government House at Wellington this 4th day of May 1970 Present:

ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL PURSUANT to section 274 of the Public Works Act 1928 and Part I of the Public Works Amendment Act 1960, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order may be cited as the Morven-Glenavy Extension Irrigation District Order 1970.

  2. The Minister of Works is hereby authorised to construct, maintain and control the water supply works described in the First Schedule hereto to serve the district described in the Second Schedule hereto.

  3. The area of land described in the said Second Schedule is hereby constituted as an irrigation district, to be known as the Morven-Glenavy Extension Irrigation District (herein referred to as the district).

  4. It is hereby declared that the water quota shall be 24 in. over the land in the district commanded by supply points and not exempted pursuant to section 13 of the Public Works Amendment Act 1960.

  5. It is hereby declared that the irrigation charge which will be payable for half of the water quota shall be one dollar and eighty cents ($1.80) per acre of land in the district commanded by supply points and not exempted as aforesaid, reducible over the first nine irrigation seasons of supply to the charges set out in the Third Schedule hereto.

  6. It is hereby declared that the respective charges which will be payable for such water as may be supplied in excess of half the water quota but not in excess of the total water quota shall be at the rate of ninety cents (90c.) per acre-foot of water received from supply points.

FIRST SCHEDULE WATER SUPPLY WORKS

THE Morven-Glenavy Extension Irrigation Works (for the irrigation of the district) by means of water drawn from the Waitaki River and from any dam or dams which are or may be constructed or acquired on the said river or any other river or stream, such water being conveyed into the district by a race or races constructed or acquired by the Minister of Works, or by any enlargement or extension thereof: the said works including all dams, weirs, reservoirs, tunnels, fluming, piping, siphons, distributors, and races, and all other works incidental to or required for the construction, maintenance, and control of the said works for the irrigation of the district.

SECOND SCHEDULE MORVEN-GLENAVY EXTENSION IRRIGATION DISTRICT ALL that area in the Canterbury Land District, Waimate County, containing 4,500 acres, more or less; bounded by a line commencing at a point on the eastern side of Crowes Road in line with the southern boundary of Rural Section 19581, Block XI, Waitaki Survey District, and proceeding westerly to and along that boundary and the southern boundaries of R.S. 17027 and Section 2, Reserve 631, to the eastern side of No. 1 State Highway; thence southerly along that roadside to a point in line with the northern boundary of Section 8, Block XI, Waitaki Survey District; thence westerly to and along that boundary to the eastern boundary of Section 23, Block VII, Waitaki Survey District; thence southerly and westerly along the eastern and southern boundaries of that section to the eastern side of Old Ferry Road; thence northerly along that roadside to a point in line with the northern side of Broad Gully Road; thence westerly to and along that roadside to the western boundary of Section 19, Block VII, Waitaki Survey District; thence northerly along the western boundaries of that section and Section 18, Block VII, Waitaki Survey District, and northerly and easterly along the western and northern boundaries of Section 6, Block III, Waitaki Survey District, and the production of the last-mentioned boundary to the eastern side of No. 1 State Highway; thence northerly along that roadside

to the southern side of Morven Road; thence easterly along that roadside and the southern side of Horsnells Road to a point in line with the western boundary of Section 16, Block IV, Waitaki Survey District; thence northerly and easterly along the western and northern boundaries of that section and the northern boundary of Section 15, Block IV, Waitaki Survey District, to the western side of Crowes Road; thence southerly along that roadside to the southernmost corner of the aforementioned Section 15, along a right line to the north-western corner of Section 1A, Maori Reserve 903, and along the eastern side of Crowes Road to the point of commencement.

As the same is more particularly delineated on the plan marked M.O.W. 23877 deposited in the office of the Minister of Works at Wellington, and thereon edged red.
