And for the better enabling you to carry these presents into effect you are hereby authorised and empowered to make and conduct any inquiry under these presents, in accordance with the Commissions of Inquiry Act 1908, at such times and places as you consider expedient, with power to adjourn from time to time and place to place as you think fit, and so that these presents shall continue in force and the inquiry may at any time and place be resumed although not regularly adjourned from time to time or place to place:
And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose, except to me in pursuance of these presents or by my direction, the contents or purport of any report so made or to be made by you or any evidence or information obtained by you in exercise of the powers conferred upon you except such evidence or information as is received in the course of a sitting open to the public:
And it is hereby declared that the powers hereby conferred shall be exercisable notwithstanding the absence at any time of any one or any two of the members hereby appointed so long as the Chairman, or a member deputed by the Chairman to act in his stead, and two other members are present and concur in the exercise of the powers:
And it is hereby declared that you have liberty to report your proceedings and recommendations under this Commission from time to time if you shall judge it expedient so to do:
And, using all due diligence, you are required to report to me in writing under your hands not later than the 31st day of October 1970 your findings and opinions on the matter aforesaid, together with such recommendations as you think fit to make in respect thereof.

Commission to Inquire into the Proposal to Raise the Level of Lake Manapouri for the Purpose of Generating Electricity

ORDER IN COUNCIL
To all to whom these presents shall come, and to:
THE HONOURABLE SIR JAMES DOUGLAS HUTCHISON, of Paraparaumu, Retired Judge of the Supreme Court of New Zealand;
ERNEST ALBERT LEE, Esquire, of Christchurch, Retired Stipendiary Magistrate; and
LEONARD GEORGE HERSTON SINCLAIR, Esquire, C.B.E., of Auckland, Retired Stipendiary Magistrate:
GREETING:
WHEREAS it is deemed expedient that a public inquiry should be made into matters concerning the proposal to raise the level of Lake Manapouri for the purpose of generating electricity and matters incidental thereto:
Now, therefore, pursuant to the Commissions of Inquiry Act 1908, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby appoint you, the said the Honourable Sir James Douglas Hutchison, Ernest Albert Lee, and Leonard George Herston Sinclair, to be a Commission to inquire into and report uponβ
(a) The facts relating to the matters which are in dispute or which are the subject of objections arising out of or consequential upon the proposal to raise the level of Lake Manapouri for the purpose of generating electricity;
(b) The rights, powers, obligations, and liabilities of the parties to the agreements which provide for the generation of electricity by the Manapouri Power Scheme and the supply of that electricity to Comalco and to the Crown, in so far as those rights, powers, obligations, and liabilities relate directly or indirectly to the raising of the level of Lake Manapouri;
(c) The immediate and longer-term effects of raising the level of Lake Manapouri upon scenery, shore-line areas, tourism, wildlife, fisheries, scientific values, recreation, and any other amenities and activities affected thereby, the measures necessary or desirable to counteract or mitigate those effects, and the feasibility and estimated cost of those measures;
(d) The effects upon the aforesaid rights, powers, obligations, and liabilities and upon the availability of electricity to Comalco and to the Crown under the said agreements of not raising the level of Lake Manapouri, the measures necessary or desirable to counteract or
mitigate those effects, and in particular any alternative proposal for the generation of electricity and the supply thereof to Comalco and to the Crown, whether from the Manapouri Power Scheme or from any other source, and the cost of that electricity
and generally to inquire into and report upon such other matters arising thereout as may come to your notice in the course of your inquiries and which you consider should be investigated in connection therewith, and to report upon any matters affecting the premises which you consider should be brought to the attention of the Government:
And with the like advice and consent I hereby appoint you, the said the Honourable Sir James Douglas Hutchison, to be the Chairman of the said Commission:

And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose, except to me in pursuance of these presents or by my direction, the contents or purport of any report made or to be made by you, or any evidence or information received by you in the course of a special sitting not open to the public as aforesaid:
And it is hereby declared that the powers hereby conferred shall be exercisable notwithstanding the absence at any time of any one member of the Commission hereby appointed, so long as the Chairman and one other member are present and concur in the exercise of such powers:
And it is hereby further declared that you have liberty to report your proceedings and findings under this Commission from time to time if you shall judge it expedient so to do:
And, using all due diligence, you are required to report to me in writing under your hands not later than the 30th day of October 1970 your findings on the matters aforesaid.
