CHARITABLE TRUSTS ACT 1957

In the Supreme Court of New Zealand
Wellington District
Wellington Registry
IN THE MATTER of the Charitable Trusts Act 1957 and IN THE
MATTER of certain charitable trusts declared by the will of
ELIZABETH HIGGS of Hastings, Hawke’s Bay, New Zealand,
widow, deceased:
PUBLIC notice is hereby given that the Presbyterian Church
Property Trustees have prepared a scheme under the provisions of Part III of the Charitable Trusts Act 1957, for variation of a trust arising under the will of Elizabeth Higgs,
of Hastings, widow, deceased. The scheme provides that the
executor of the will of the said Elizabeth Higgs deceased be
authorised to sell a residential property in King Street,
Hastings, bequeathed to the Presbyterian Church Property
Trustees for use as a rest-home in Hastings for women of all
denominations, and that the executor pay the proceeds of
such sale to the Presbyterian Church Property Trustees upon
trust to pay the costs of and incidental to the preparation and
approval of the scheme and subject thereto to be applied by
the Presbyterian Social Services Association of Hawke’s Bay
and Poverty Bay (Incorporated) for and towards the
development support and maintenance of a rest-home or
rest-homes in Hastings for women of all denominations. The
scheme has been prepared because the property bequeathed
is inadequate and unsuitable for use as a rest-home and the
trustees consider that the wishes of the testatrix will be best
met in the manner proposed.
The application of the Presbyterian Church Property
Trustees for approval of the scheme is to be heard in the
Supreme Court at Wellington on Wednesday, the 29th day of
April 1970. Any person desiring to oppose the scheme is
hereby required to give written notice of his intention to do
so to the Registrar of the Supreme Court at Wellington, the
Presbyterian Church Property Trustees, and the Attorney
General not less than 7 clear days before the said 29th day
of April 1970.
The address for service of the Presbyterian Church
Property Trustees is at the offices of Messrs Macalister
Mazengarb Parkin and Rose, Solicitors, National Bank
