Notice of Intention to Take Land in the Borough of Green Island for Stream Diversion Purposes

NOTICE is hereby given that it is proposed, under the provisions of the Public Works Act 1928, to execute a certain public work, namely, the diversion of the Kaikorai Stream; and, for the purpose of such public work, the land described in the Schedule hereto is required to be taken for stream diversion purposes. And notice is hereby further given that the plan of the land so required to be taken is deposited in the post office at Green Island and is there open for inspection; that all persons affected by the execution of the said public work or by the taking of the said land should, if they have any objections to the execution of the said public work or to the taking of the said land, not being objections to the amount or payment of compensation, set forth the same, in writing, and send the written objection, within forty (40) days of the first publication of this notice, to the Minister of Works at Wellington; and that, if any objection is made in accordance with this notice, a public hearing of the objection will be held, unless the objector otherwise requires, and each objector will be advised of the time and place of the hearing.

Agreement for Grant of Right of Way in Favour of W. Haythorn-Thwaite Ltd., at Auckland, Over Land in the City of Auckland, Taken for Better Utilisation, Assented to

WHEREAS by a Proclamation dated the 1st day of July 1965 and published in the Gazette, 29 July 1965, Vol. II, p. 1202, all that piece of land containing 23.9 perches, being Lot 1 and part Lot 2, D.P. 17062, and parts Lot 5, D.P. 8101, all certificate of title, Volume 424, folio 113, North Auckland Land Registry, was taken for the Auckland-Hamilton Motorway;

And whereas W. Haythorn-Thwaite Ltd., at Auckland, is entitled to compensation in respect of the said land;

And whereas the Minister of Works has agreed to grant the said W. Haythorn-Thwaite Ltd. a right of way over the land described in the Schedule hereto, in part satisfaction of the compensation aforesaid;

And whereas the said W. Haythorn-Thwaite Ltd. has agreed to accept such grant of right of way in part satisfaction of the said compensation:

Now, therefore, the Minister of Works hereby gives notice, pursuant to section 97 of the Public Works Act 1928, that he assents to the agreement hereinbefore referred to.

ALL that piece of land containing 1.1 perches situated in the City of Auckland, North Auckland R.D., and being part Lot 4, D.P. 10257 (part Gazette notice 16549); as the same is more particularly delineated on the plan marked M.O.W. 22276 (S.O. 45749) deposited in the office of the Minister of Works at Wellington, and thereon coloured blue.

Amending a Notice Proclaiming Land as Road, Road Closed, Road Closed and Vested, Land Taken, and Land Taken and Vested in Otahoua Survey District, Masterton County

PURSUANT to the Public Works Act 1928, the Minister of Works hereby amends the notice dated the 14th day of August 1968 and published in Gazette, 19 September 1968, No. 58, p. 1604, proclaiming inter alia road closed and vested, by deleting the name "Morvyn William's" as appearing therein and substituting the name "Morvyn Williams" in lieu thereof.

Revoking Licence for Oyster Plots in Kaipara Harbour

PURSUANT to the Harbours Act 1950, the Minister of Marine hereby gives notice that the licence signed on 21 January 1964*, authorising Hugh Cameron McRae to use and occupy part of the foreshore and bed of Kaipara Harbour as a site for oyster plots, is hereby revoked.

Licensing Otehei Bay Co. Ltd. to Occupy a Site for a Wharf in Bay of Islands

PURSUANT to the Harbours Act 1950, the Minister of Marine hereby licenses and permits Otehei Bay Co. Ltd. (hereinafter called the licensee, which term shall include its successors or assigns unless the context requires a different construction) to use and occupy a part of the foreshore and bed of Otehei Bay, Bay of Islands, as shown on plan marked M.D. 6248 and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a wharf as shown on the said plan, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE

CONDITIONS

1. This licence is subject to the Foreshore Licence Regulations 1960 and the provisions of those regulations shall, so far as applicable, apply hereto.

2. The term of the licence shall be 14 years from the 1st day of October 1968.

3. The premium payable by the licensee shall be 6 dollars ($6) and the annual sum so payable by the licensee shall be 20 dollars ($20).
