Declaring Land and an Easement of Right of Way Taken for Sanitary Works in the City of Hamilton

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for sanitary works and the easement, being the right of way described in the Second Schedule hereto, is hereby taken for sanitary works over the land described in the Third Schedule hereto; and that both the said land described in the First Schedule hereto and the said easement described in the Second Schedule hereto shall vest in the Mayor, Councillors, and Citizens of the City of Hamilton (hereinafter called the Council) from and after the 3rd day of November 1969.

The full and free right, liberty, licence, and authority in perpetuity for the Council to construct and use a right of way, with the right for the Council’s servants, agents, workmen, licensees, and invitees to go, pass, and repass, with or without horses or other animals and vehicles, over the land described in the Third Schedule hereto, and to maintain, repair, and keep open the said right of way for the purpose of providing access to the land described in the First Schedule hereto, such right of way to be held appurtenant to the land described in the First Schedule hereto.

PURSUANT to section 32 of the Public Works Act 1928 and section 15 of the Broadcasting Corporation Act 1961, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the Schedule hereto is hereby taken for broadcasting purposes and shall vest in the New Zealand Broadcasting Corporation from and after the 3rd day of November 1969.
