Declaring Land and Easement over Land Taken for Waterworks (Storm-water Pumping Station) in the Borough of Petone
PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land first described in the Schedule hereto is hereby taken for waterworks (storm- water pumping station) and shall vest in the Mayor, Councillors, and Citizens of the Borough of Petone from and after the 13th day of October 1969; and also hereby declares that an easement in connection therewith and forever appurte- nant thereto is hereby taken over the land secondly described in the Schedule hereto, vesting in the Mayor, Councillors, and Citizens of the Borough of Petone the full and free right, liberty, licence, and privilege in perpetuity, that is to say
(a) to carry, convey, and drain water, whether rain, storm, spring, soakage, or seepage water, in any quantities through, over, and along the land secondly described in the Schedule hereto and to discharge the same beyond the said land;
(b) the right of ingress, egress, and regress on foot, with or without vehicles of all descriptions, either loaded or unloaded, by night as well as by day, over, and along the land secondly described in the Schedule hereto;
