Pursuant to section 25 of the Public Works Act 1928, the Minister of Works hereby declares the land described in the Schedule hereto to be set apart for road from and after the 6th day of October 1969.

Land Proclaimed as Road and Road Closed and Vested in Block VIII, Waiheke Survey District, Waiheke Road District

Pursuant to section 29 of the Public Works Amendment Act 1948, the Minister of Works hereby proclaims as road the land described in the First and Second Schedules hereto, and hereby proclaims as closed the road described in the Third and Fourth Schedules hereto: also hereby proclaims that the closed road described in the Third Schedule hereto shall vest in Allan Clive Mabey and Laurence Clive Mabey, both of Waiheke, farmers, as tenants-in-common in equal shares, subject to a mining easement created by transfer No. A. 158143, and subject to memoranda of mortgage No. A. 158145 and A. 300139; and also hereby proclaims that the closed road described in the Fourth Schedule hereto shall vest in Bruce Stuart Philcox, of Mount Eden, farmer, subject to memorandum of mortgage No. 369969, and an electricity transmission easement in gross granted to the Auckland Electric Power Board by transfer No. 649123, North Auckland Land Registry.
