Decisions of the Indecent Publications Tribunal
No. 139–141
IN the matter of the Indecent Publications Act 1963, and in the matter of an application to the Tribunal for decisions in respect of the following magazines:
Modern Man, the Adult Picture Magazine, November 1968;
Modern Sunbathing Quarterly, Vol. 50 (811), Winter 1969;
and
Tiger, the Book-Magazine for Real Men, No. 7 (811), Winter 1969.
DECISIONS OF THE TRIBUNAL
THESE three magazines, published by Publishers’ Development Corporation, Skokie, Illinois, U.S.A., have been considered by the Tribunal on the application of the Comptroller of Customs. No submissions were received from the Comptroller but Mr Whittaker of R. F. Whittaker Ltd., the importer of the magazines, appeared at the hearing and made submissions.
In respect of each magazine the Tribunal decides as follows:
Modern Man, the Adult Picture Magazine, November 1968.
The magazine is about sex. The pictures are of nudes and seminudes in various poses ranging from the merely provocative to the perverted and contrived; the articles are slight in content, trivial in tone, and on such themes as “Nutty Neuters”, “The Lowdown on Kinky Sex”, “Hot Films”, “How to Mix Pleasure with Business”. The advertisements are for blue films, “raised skirt” photographs, and the paraphernalia of the perversions. In our view this magazine is indecent in the sense that it deals with sex in a manner that is injurious to the public good and we decide accordingly.
Modern Sunbathing Quarterly, Vol. 50 (811), Winter 1969.
Modern Sunbathing Quarterly is a nudist or naturist magazine with additional emphases. The practice resorted to by the publishers of painting out the pubic areas results in graceless and unnatural representations of the human form and is dishonest and offensive. In our opinion the magazine is indecent in terms of the Act and we decide accordingly.
Tiger, the Book-Magazine for Real Men, No. 7 (811), Winter 1969.
The issue of Tiger referred to us is in our opinion objectionable. There is too much extreme artificiality in the posing of photographs; there are overtones of horror and violence and preoccupation with aberration for the sake of aberration. We do not consider the presentation to be healthy or in the public interest and we decide that it is indecent in terms of the Act.
