In the matter of the Companies Act 1955, and in the matter of J. G. Marshall Ltd. (in liquidation), notice is hereby given that the undersigned, the liquidator of J. G. Marshall Ltd., which is being wound up voluntarily, does hereby fix the 13th day of January 1969 as the day on or before which the creditors of the company are to prove their debts or claims and to establish any title they may have to priority under section 308 of the Companies Act 1955, or to be excluded from the benefit of any distribution made before the debts are proved or, as the case may be, from objecting to the distribution.

REDUCTION OF CAPITAL

In the matter of the Companies Act 1955, Section 78 (3), and in the matter of the Golden Spur Company Limited: NOTICE IS HEREBY GIVEN that the order of the Supreme Court of New Zealand dated the 4th day of December 1968, confirming the reduction of capital of the above-named company from $24,000 to $4,200 and the minute approved by the Court showing, with respect to the capital of the company as altered, the several particulars required by the above-mentioned Act, was registered by the Registrar of Companies on the 11th day of December 1968.
The said minute is in the words and figures following:
“The capital of the Golden Spur Company Limited is $4,200 divided into 24,000 shares of 20c each having been reduced from $24,000 divided into 24,000 ordinary shares of $1 each”.

IN THE MATTER of the Charitable Trusts Act 1957 AND IN THE MATTER of the HENRY HASELER TRUST established under the will of Henry Haseler, deceased, late of Howick, farmer:

NOTICE is hereby given that THE GENERAL TRUST BOARD OF THE DIOCESE OF AUCKLAND, the trustee of the estate of the above-named, has filed in the Supreme Court at Auckland a motion for an order approving a scheme for the variation of the trusts imposed by the will of the said Henry Haseler, deceased, it being alleged by the said trustee that it is impossible impracticable and inexpedient to carry out the charitable purpose expressed in the said will. The said scheme provides:

  1. THIS scheme relates to the residuary estate set out in the will of Henry Haseler, late of Howick, deceased, excluding a capital fund of $50,000 in the form of land moneys and other assets at present held by the General Trust Board of the Diocese of Auckland (hereinafter referred to as “the trustee”).

  2. FROM and after the date on which the scheme is approved by an order made by a Judge of the Supreme Court of New Zealand the said residuary estate excluding the capital fund of $50,000 shall no longer be held upon the trusts set out in the said will but shall be held upon the trusts hereinafter declared and disposed of in accordance with the provisions of the scheme.

  3. THE trustee shall hold and apply the residuary estate excluding the capital fund of $50,000 mentioned and referred to in the last will and testament of Henry Haseler, late of Howick, farmer, deceased, for the purposes (either alone or with any other moneys donated or otherwise made available for the purpose) of erecting and furnishing a new church and ancillary buildings in the Parochial District of Howick on such a site as shall appear most suitable in the opinion of the Trustee for the erection of a new church and ancillary buildings. Any balance of the capital as well as the income of the residuary fund (excluding the capital fund of $50,000) after meeting the cost of the erection and furnishing of the said new church and ancillary buildings is to be held by the trustee and applied for the general parish purposes whether charitable or religious of the Parochial District of Howick.

NOTICE is further given that the motion is to be heard by the Supreme Court at Auckland on Friday, the 21st day of February 1969, at 10 o’clock in the forenoon and any person desiring to oppose the scheme is hereby required to give written notice of his intention to do so to the Registrar of the Supreme Court at Auckland and to the trustee at the offices of their solicitors under-mentioned and to the Attorney-General not less than 7 clear days before the said date of hearing.
