Declaring Land Taken for Railway Purposes, Vested in the Palmerston North City Corporation subject to Certain Conditions

A PROCLAMATION

PURSUANT to subsection (2) of section 26 of the Reserves and Other Lands Disposal Act 1939, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, hereby proclaim and declare that the land in the Schedule hereto, being taken for railway purposes on the Palmerston North deviation of the Wellington to New Plymouth line of railway, shall be vested in the Palmerston North City Corporation, in trust for the purpose of beautifying the environs of the Palmerston North station and providing recreation grounds and playing areas in close proximity thereto or for any similar purpose to the intent that the land shall forever remain public in character and subject to the condition that no building structure or erection of any kind shall be built erected or placed upon the said land without the written consent of the Minister of Railways first had and obtained and that any such consent so given shall be subject to such terms and conditions as the Minister deems fit to impose for the purpose of ensuring that the land shall remain public in character as aforesaid.

PURSUANT to section 18 of the Forests Act 1949, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, hereby set apart the Crown land described in the Schedule hereto as provisional State forest land.

SECTIONS 16 to 44 inclusive, 55 to 58 inclusive, and 85 to 90 inclusive, Town of Muriwhenua, situated in Block XV, Opoe Survey District; Sections 45 to 53 inclusive, and 104, Town of Muriwhenua, situated in Block XI, Opoe Survey District; and Section 54, Town of Muriwhenua, situated in Block VIII, Opoe Survey District: Total area, 17 acres 2 roods 6.3 perches, more or less. (S.O. Plans 29711, 29713, 29715, 29717.) As shown on plans numbered 2/11, 2/12, 2/13, 2/14, deposited in the Head Office of the New Zealand Forest Service, and thereon bordered red.

A PROCLAMATION

PURSUANT to subsection (6) of section 5 of the Education Lands Act 1949, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto, being an area vested in the Otago Education Board as a site for a school, shall be vested in Her Majesty the Queen, freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens, or easements affecting the same at the date hereof.

PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portions of road described in the Schedule hereto shall, on and after the date of this Order in Council, become county road.

SCHEDULE
SOUTH AUCKLAND LAND DISTRICT

ALL that portion of Maleme Road, situated in Blocks I and IV, Ngongotaha Survey District, Rotorua County, commencing at a point approximately 24 chains south of the north-eastern corner of Section 2, Block VIII, Atiamuri Survey District, and proceeding generally in a south-westerly direction for a distance of approximately 320 chains, terminating at the westernmost corner of Section 39, Block IV, Ngongotaha Survey District; as the same is more particularly delineated on the plans marked M.O.W. 22068 (S.O. 44029), M.O.W. 22069 (S.O. 44033), M.O.W. 22070 (S.O. 44034), and M.O.W. 22071 (S.O. 44035) deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B, B-C, C-D, and D-E respectively.

Also, all that portion of road, situated in Block IV Ngongotaha Survey District, commencing at the westernmost corner of Section 37, Block IV, Ngongotaha Survey District, and proceeding generally easterly for a distance of approximately 127 chains, terminating at the easternmost corner of Section 40, Block IV, Ngongotaha Survey District; as the same is more particularly delineated on the plan marked M.O.W. 22071 (S.O. 44035) deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked F-G.
