Allocating Railway Land for Street in the Borough of Port Chalmers

A PROCLAMATION
PURSUANT to section 226 of the Public Works Act 1928, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto (and which was taken for the South Island Main Trunk Railway and is not now required for such purpose) shall, upon the publication hereof in the Gazette, become street; and that such street shall be under the control of the Port Chalmers Borough Council, and shall be maintained by the said Port Chalmers Borough Council in like manner as other public streets are controlled and maintained by the said Council.

PURSUANT to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to stopping the portion of road described in the Schedule hereto.

ALL that portion of road containing 1 acre 2 roods 6.2 perches situated in Block VI, Heretaunga Survey District, Hawke’s Bay County, Hawke’s Bay R.D., and adjoining or passing through part Lot 14, D.P. 134, being part Omaranui Block, and part Section 1; as the same is more particularly delineated on the plan marked M.O.W. 22707 (S.O. 5765) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

PURSUANT to the Local Government Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

This order shall come into force on 1 April 1969.

The area described in the Schedule hereto shall be excluded from the County of Rangiora and included in the Borough of Rangiora.

The alteration of the boundaries of the said county and the said borough, hereinbefore made, shall be deemed to have been effected under the Municipal Corporations Act 1954.
SCHEDULE
ALL that area in the Rangiora County, Canterbury Land District, containing 6 acres, more or less, bounded by a line commencing at the north-western corner of Lot 1, D.P. 14817, and proceeding easterly along the northern boundary of that lot a distance of 5 chains; thence southerly along a line parallel to and 5 chains east of the eastern side of East Belt a distance of 12 chains; thence westerly along a line at right angles to East Belt to the eastern side of East Belt; thence northerly along that roadside to the point of commencement.
