Boundaries of Manawatu County and Feilding Borough Altered

At the Government Buildings at Wellington this 12th day of February 1968

Present:

THE RIGHT HON. J. R. MARSHALL PRESIDING IN COUNCIL

PURSUANT to the Municipal Corporations Act 1954, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order shall come into force on the 1st day of April 1968.

  2. The area described in the Schedule hereto is hereby excluded from the County of Manawatu and included in the Borough of Feilding.

SCHEDULE

FIRSTLY, all that area in the Wellington Land District, comprising portion of the County of Manawatu, containing 66 acres, more or less, bounded by a line commencing at the easternmost corner of Lot 3, D.P. 20039, being a point on the boundary of the Borough of Feilding, as described in Gazette, 1959, at page 464, and proceeding generally southerly along the eastern and southern boundaries of that lot, the left bank of the Makino Stream, the northern boundary of Lot 7, D.P. 1691, the south-eastern boundary of Lot 1, D.P. 4022, a right line across Rata Street to the easternmost corner of Lot 2, D.P. 4022, and the south-eastern boundary of that lot to the northern boundary of Lot 2, D.P. 912; thence westerly along that boundary to the eastern side of the Feilding-Awahuri Road and south-westerly along the eastern side of that road to a point in line with the southern boundary of Lot 12, D.P. 19521; thence generally westerly to and along that boundary, the southern and western boundaries of Lot 1, D.P. 15654, the southern boundaries of Lot 11, D.P. 1351, and Lot 50, D.P. 2366; thence generally northerly along the eastern side of Osborne Terrace to the southern side of Haggitt Street, being a point on the boundary of the Borough of Feilding aforesaid; thence westerly generally along that boundary to the point of commencement.

Secondly, all that area in the Wellington Land District, comprising portion of the County of Manawatu, containing 8 acres, more or less, bounded by a line commencing at the northernmost corner of part Lot 2, D.P. 1786, being a point on the boundary of the Borough of Feilding, as described in Gazette, 1959, at page 464, and proceeding westerly to and along the southern side of Glasgow Terrace to the north-western corner of Lot 7, D.P. 2366, and a right line across Glasgow Terrace to the south-western corner of Lot 1, D.P. 2366; thence north-easterly generally along the western boundary of that lot, the northern boundaries of Lots 1, 2, 3, 4, and 5, D.P. 2366, and the western boundary of Lot 4, D.P. 2289, to the south-western corner of Lot 2, D.P. 5081, being a point on the boundary of the Borough of Feilding aforesaid; thence southerly generally along that boundary to the point of commencement.

Authorising Donald Mount Cook Burnett, of Fairlie, Sheep-farmer, to Use Water for the Purpose of Generating Electricity, and to Erect and Use Certain Electric Lines, and Revoking a Previous Licence

ORDER IN COUNCIL

At the Government Buildings at Wellington this 5th day of February 1968

Present:

THE RIGHT HON. KEITH HOLYOAKE, C.H., PRESIDING IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Donald Mount Cook Burnett, of Fairlie, sheep-farmer (hereinafter referred to as the licensee), a licence subject to the conditions hereinafter set forth to take and use from the waters of Andrew’s Creek (hereinafter referred to as the said stream) situated in Run 83, Cass Survey District, in the Land District of Canterbury, County of Mackenzie, for the purposes hereinafter set forth, a stream of water not exceeding one cubic foot per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described;

and further revokes the Order in Council dated the 22nd day of March 1948, and published in the Gazette on the 1st day of April 1948 at page 347, authorising the licensee to use water for the purpose of generating electricity and to erect and use certain electric lines.

CONDITIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Waterpower Regulations 1934 and the Electrical Supply Regulations 1967 shall be incorporated in, and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

LICENCE SUBJECT TO REGULATIONS

  1. This licence is issued under the Water-power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1967, the Electrical Wiring Regulations 1961, and the Radio Interference Regulations 1958, and to all regulations hereafter made in amendment thereof or in substitution therefore respectively.

UTILISATION OF WATER AND LOCATION OF HEADWORKS

  1. Water shall be used under this licence solely for the purpose of generating electricity, and shall be taken from the said stream at a point in Run 83, Cass Survey District, in the Land District of Canterbury, as indicated on the plans marked NZED 9 and 10 deposited in the office of the New Zealand Electricity Department at Wellington.

GENERAL DESCRIPTION OF WORKS

  1. The licensee is hereby authorised subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this licence, the positions of the said works being indicated on the said plans NZED 9 and 10:

(a) Headworks consisting of a dam and intake giving a static head of approximately 605 ft:

(b) Pipe-line from such headworks to the power-house hereinafter described:

(c) Pelton wheel and power-house with all necessary equipment for generating electricity, situated in Run 83, Block XV, Cass Survey District:

(d) Tail-race leading from the power-house to the said stream:

(e) Electric lines leading from the said power-house across Block XV, Macleod’s Creek, Rural Section 34194 and part Rural Section 34193, all in Cass Survey District, to the licensee’s dwelling, other buildings, and pump, all being situated in part Rural Section 34193, Block I, Jollie Survey District, the said lines being indicated by means of blue lines on the said plan NZED 10.

DURATION OF LICENCE

  1. This licence shall, unless sooner lawfully determined, continue in force until the 31st day of March 1989, or until electrical energy is available from an electric-power board or other public source of supply, whichever is the earlier.

SYSTEM OF SUPPLY

  1. The system of supply shall be as described in paragraphs (d) and (e) of clause 15 of the Electrical Supply Regulations 1967. The generating voltage shall be approximately 230 volts and the transmission voltage shall be approximately 11,000 volts alternating current.

RENTAL

  1. For the purpose of assessing the rental or annual sum payable in respect of the licence, the present plant is rated at 30 kilowatts.

NO RIGHT TO WATER CONFERRED

  1. Nothing in this licence shall of itself confer upon the licensee any right to water.

THE RIGHT HON. KEITH HOLYOAKE, C.H., PRESIDING IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and with the consent of the licensee, hereby revokes the Order in Council dated the 22nd day of May 1963, and published in the Gazette on the 30th day of the same month at page 738, authorising the Urewera National Park Board to erect and use certain electric lines in the County of Wairoa.
